(1) Existing law requires the Department of Motor Vehicles (DMV) to require an applicant for an original driver’s license or identification card to submit satisfactory proof that the applicant’s presence in the United States is authorized under federal law. Existing law prohibits the department from issuing an original driver’s license or identification card to a person who does not submit satisfactory proof that his or her presence in the United States is authorized under federal law. Existing law makes it a misdemeanor for a person to knowingly assist in obtaining a driver’s license or identification card for a person whose presence in the United States is not authorized under federal law.
This bill would delete these provisionsbegin insert
as to driver’s licensesend insert, and would make other technical and conforming changes. The bill would instead authorize an applicant for abegin insert noncommercialend insert driver’s license who is not eligible for a social security account number, but who provides proof of identity, as specified, to receive an original driver’sbegin delete license, except as provided,end deletebegin insert licenseend insert if he or she meets all other qualifications for licensure. (2) Existing law requires each form prescribed by the DMV for use by an applicant for the issuance or renewal of a driver’s license or identification card to contain a section for the applicant’s social security account number. Existing law prohibits the inclusion of an applicant’s social security account number on a driver’s license, identification card, registration, certificate of title, or other document issued by the DMV or the display of an applicant’s social security account number on the driver’s license.

The people of the State of California do enact as follows:
The Legislature finds and declares all of the
2following:
P3 1(a) According to a report by the AAA Foundation for Traffic
2Safety, car crashes rank among the leading causes of death in the
3United States.
4(b) Previous studies done by the foundation have found that
5approximately one in five fatal crashes in the United States involve
6an unlicensed or invalidly licensed driver.
7(c) The California Department of Motor Vehicles, Licensing
8Operations Division, Research and Development Branch has stated
9that unlicensed driving is a
major California safety problem.
10(d) In a report titled, “Estimating the Exposure and Fatal Crash
11Rates of Suspended/Revoked and Unlicensed Drivers in California”
12published in Accident Analysis and Prevention, 29(1), the
13Department of Motor Vehicles estimates that 12 percent of the
14drivers on the road do not have valid driver’s licenses.
15(e) In the State of California, there are potentially one million
16drivers who are unlicensed and uninsured.
17(f) It is our responsibility to ensure that all California drivers
18are properly trained, tested, and insured in order to make our roads
19safer.
Section 1653.5 of the Vehicle Code is amended to
21read:
(a) Every form prescribed by the department for use
23by an applicant for the issuance or renewal by the department of
24a driver’s license or identification card pursuant to Division 6
25(commencing with Section 12500) shall contain a section for the
26applicant’s social security account number.
27(b) Every form prescribed by the department for use by an
28applicant for the issuance, renewal, or transfer of the registration
29or certificate of title to a vehicle shall contain a section for the
30applicant’s driver’s license or identification card number.
31(c) A person who submits to the department a form
that, pursuant
32to subdivision (a), contains a section for the applicant’s social
33security account number, or pursuant to subdivision (b), the
34applicant’s driver’s license or identification card number, if any,
35shall furnish the appropriate number in the space provided.
36(d) The department shall not complete an application that does
37not include the applicant’s social security account number or
38driver’s license or identification card number as required under
39subdivision (c).

2included by the department on a driver’s license, identification
3card, registration, certificate of title, or any other document issued
4by the department.
5(f) Notwithstanding any other
law, information regarding an

14Chapter 7 of Title 42 of the United States Code.
15(2) Implementation of Section 12419.10 of the Government
16Code.
17(3) Responding to information requests from the Franchise Tax
18Board for the purpose of tax administration.
19(g) This section shall remain in effect only until January 1, 2015,
20and as of that date is repealed, unless a later enacted statute, that
21is enacted before January 1, 2015, deletes or extends that date.

25with any document that the department finds clearly establishes
26the identity of the applicant, which is obtained by the department
27pursuant to this section or Section 12800 or 12801, is not a public
28record and may not be disclosed by the department except for any
29of the following purposes:
30(1) Responding to a request for information from an agency
31operating pursuant to, and carrying out the provisions of, Part A
32(Aid to Families with Dependent Children), or Part D (Child
33Support and Establishment of Paternity), of Subchapter IV of
34Chapter 7 of Title 42 of the United States Code.
35(2) Implementation of Section 12419.10 of the Government
36Code.

Section 12800 of the Vehicle Code is amended to read:

11a driver and, if so, when and in what state or country and whether
12or not the license has been suspended or revoked and, if so, the
13date of and reason for the suspension or revocation.
14(f) Whether the applicant has ever previously been refused a
15driver’s license in this state and, if so, the date of and the reason
16for the refusal.
17(g) Whether the applicant, within the last three years, has
18experienced, on one or more occasions, either a lapse of
19consciousness or an episode of marked confusion caused by a
20condition that may bring about recurrent lapses, or whether the
21applicant has a disease, disorder, or disability that affects his or
22her ability to exercise
reasonable and ordinary control in operating
23a motor vehicle upon a highway.
24(h) Whether the applicant understands traffic signs and signals.
25(i) Whether the applicant has ever previously been issued an
26identification card by the department.
27(j) Any other information that is necessary to enable the
28department to determine whether the applicant is entitled to a
29license under this code.
30(k) This section shall remain in effect only until January 1, 2015,
31and as of that date is repealed, unless a later enacted statute, that
32is enacted before January 1, 2015, deletes or extends that date.
Section 12800 is added to the Vehicle Code, to read:

Section 12801 of the Vehicle Code is amended to read:
(a) Notwithstanding any other law, the department

30applicant’s social security account number and any other number
31or identifier determined to be appropriate by the department.
32(b) Notwithstanding subdivision (a), an applicant who provides
33satisfactory proof that his or her presence in the United States is
34authorized under federal law, but who is not eligible for a social
35security account number, is eligible to receive an original driver’s
36license if he or she meets all other qualifications for licensure.
37(c) Notwithstanding any other law, the social security account
38number
collected on a driver’s license application shall not be
39
displayed on the driver’s licensebegin insert,end insert including, but not limited to,
P8 1inclusion on a magnetic tape or strip used to store data on the
2license.
3(d) This section shall remain in effect only until January 1, 2015,
4and as of that date is repealed, unless a later enacted statute, that
5is enacted before January 1, 2015, deletes or extends that date.
Section 12801 is added to the Vehicle Code, to read:
(a) Notwithstanding any other law, the department
8shall require an application for a driver’s license to contain the
9applicant’s social security account number and, except as provided
10in Section 12801.1, any other number or identifier determined to
11be appropriate by the department.
12(b) Notwithstanding subdivision (a), an applicant who provides
13satisfactory proof that his or her presence in the United States is
14authorized under federal law, or who provides all of the following
15documents, but who is not eligible for a social security account
16number, is eligible to receive an original driver’s license, except
17as provided in Section 12801.1, if he or she meets all other
18qualifications
for licensure:
19(1) A valid, unexpired consular identification document issued
20
by a consulate from the applicant’s country of citizenship, or a
21valid, unexpired passport from the applicant’s country of
22citizenship.
23(2) An original birth certificate, or other proof of age, as
24designated by the department.
25(3) A home utility bill, lease or rental agreement, or other proof
26of California residence, as designated by the department.
27(4) One of the following documents, which, if in a language
28other than English, shall be accompanied by a certified translation
29or an affidavit of translation into English:
30(A) A marriage license or divorce certificate.
31(B) A foreign federal
electoral photo card issued on or after
32January 1, 1991.
33(C) A foreign driver’s license.
34(D) A United States Department of Homeland Security Form
35I-589, Application for Asylum and for Withholding of Removal.
36(E) An official school or college transcript that includes the
37applicant’s date of birth, or a foreign school record that is sealed
38and includes a photograph of the applicant at the age the record
39was issued.
P9 1(F) A United States Department of Homeland Security Form
2I-20 or Form DS-2019.
3(G) A deed or title to real property.
4(H) A property tax bill or statement issued within the previous
512 months.
6(I) An income tax return.
7(J) Other proof of identity, as designated by the department.
8(c) Notwithstanding any other law, the social security account
9number or other identification number collected on a driver’s
10license application shall not be displayed on the driver’s license,
11including, but not limited to, inclusion on a magnetic tape or strip
12used to store data on the license.
13(d) Notwithstanding any other law, information collected
14pursuant to subdivision (b) is not a public record and shall not be
15disclosed by the department for any purpose.
16(e) This section shall become operative on January 1, 2015.
Section 12801.1 is added to the Vehicle Code, to read:
(a) The department shall require an application for
19a commercial driver’s license to include the applicant’s social
20security account number.
21(b) This section shall become operative on January 1, 2015.
Section 12801.5 of the Vehicle Code is amended to
23read:
(a) Notwithstanding any other law, the department
25shall require an applicant for an original driver’s license or
26identification card to submit satisfactory proof that the applicant’s
27presence in the United States is authorized under federal law.
28(b) The department shall not issue an original driver’s license
29or identification card to a person who does not submit satisfactory
30proof that the applicant’s presence in the United States is authorized
31under federal law.
32(c) The department shall adopt regulations to carry out the
33purposes of this section, including procedures for, but not limited
34to,
(1) verifying that the applicant’s presence in the United States
35is authorized under federal law, (2) issuance of a temporary license
36pending verification of the applicant’s status, and (3) appeal
37hearings from a denial of a license, temporary license, or
38identification card.
39(d) On January 10 of each year, the department shall submit a
40supplemental budget report to the Governor and the Legislature
P10 1detailing the costs of verifying the citizenship or legal residency
2of applicants for driver’s licenses and identification cards, in order
3for the state to request reimbursement from the federal government.
4(e) Notwithstanding Section 40300 or any other provision of
5law, a peace officer may not detain or arrest a person solely on the
6belief that the person is an unlicensed driver, unless the
officer has
7reasonable cause to believe the person driving is under the age of
816 years.
9(f) The inability to obtain a driver’s license pursuant to this
10section does not abrogate or diminish in any respect the legal
11requirement of every driver in this state to obey the motor vehicle
12laws of this state, including laws with respect to licensing, motor
13vehicle registration, and financial responsibility.
14(g) This section shall remain in effect only until January 1, 2015,
15and as of that date is repealed, unless a later enacted statute, that
16is enacted before January 1, 2015, deletes or extends that date.
Section 12801.5 is added to the Vehicle Code, to
18read:
(a) Notwithstanding Section 40300 or any other law,
20a peace officer may not detain or arrest a person solely on the belief
21that the person is an unlicensed driver, unless the officer has
22reasonable cause to believe the person driving is under the age of
2316 years.
24(b) The inability to obtain a driver’s license does not abrogate
25or diminish in any respect the legal requirement of every driver in
26this state to obey the motor vehicle laws of this state, including
27laws with respect to licensing, motor vehicle registration, and
28financial responsibility.
29(c) This section shall become operative on January 1, 2015.
Section 12801.6 of the Vehicle Codebegin delete, as added by is amended to
31Section 3 of Chapter 862 of the Statutes of 2012,end delete
32read:
(a) Any federal document demonstrating favorable
34action by the federal government for acceptance of a person into
35the deferred action for childhood arrivals program shall satisfy the
36requirements of Section 12801.5.
37(b) The department may issue an original driver’s license to the
38person who submits proof of presence in the United States as
39authorized under federal law pursuant to subdivision (a) and either
P11 1a social security account number or ineligibility for a social security
2account number.
3(c) This section shall remain in effect only until January 1, 2015,
4and as of that date is repealed, unless a later
enacted statute, that
5is enacted before January 1, 2015, deletes or extends that date.
Section 12801.8 of the Vehicle Code is amended to
7read:
(a) In the case of a legal, nonimmigrant driver’s
9license applicant, the department shall issue a temporary driver’s
10license, valid for 90 days, if the applicant has successfully
11completed the application and the related requirements for the
12issuance of a driver’s license under this code, including subdivision
13(a) of Section 12805. If the United States Immigration and
14Naturalization Service is unable to verify the applicant’s presence
15before the temporary driver’s license expires, the department shall,
16at least 15 days before the temporary driver’s license expires,
17extend the temporary driver’s license for an additional 120 days
18and notify the applicant by mail that the temporary driver’s license
19is
being extended.
20(b) If the department adjusts the expiration date of any driver’s
21license issued pursuant to this code so that the date does not exceed
22the expiration date of a federal document submitted pursuant to
23subdivision (a) of Section 12801.5, the applicant may, upon receipt
24of a notice of renewal of the driver’s license by the department
25sent prior to the expiration of the license, request an extension of
26the term of the driver’s license by submitting to the department
27satisfactory proof that the applicant’s presence in the United States
28has been reauthorized or extended under federal law. After
29verifying that the applicant’s presence in the United States has
30been reauthorized or extended by federal law, the department shall
31adjust the expiration date of the driver’s license so that it does not
32exceed the expiration date of the
revised federal document
33submitted pursuant to subdivision (a) of Section 12801.5 and
34complies with the related requirements of this code.
35(c) On or before July 1, 1997, the department shall establish a
36procedure for receiving mailed requests for the extension of driver’s
37licenses as described in this section.
38(d) This section shall remain in effect only until January 1, 2015,
39and as of that date is repealed, unless a later enacted statute, that
40is enacted before January 1, 2015, deletes or extends that date.

21of applicants for identification cards, in order for the state to
22request reimbursement from the federal government.
23(e) This section shall become operative on January 1, 2015.

33the applicant following expiration of the identification card

35received after 90 days after expiration of the identification card,
36including a senior citizen identification card, shall be considered
37the same as an application for an original identification card. The
38department shall, at the end of six years and six months after the
39issuance or renewal of an identification card, other than a senior

2expired and has not been renewed.

16(1) The person has a physical or mental condition and requests
17cancellation of the driver’s license.
18(2) The department has revoked the person’s driving privilege
19based on the person’s physical or mental condition.
20That card shall be issued without the payment of any additional
21fee.
22(d) Notwithstanding subdivisions (a) and (b), the department
23may adjust the expiration date of any identification card issued
24pursuant
to this code so that the date does not exceed the expiration
25date of a document submitted pursuant to subdivision (a) of Section
2612801.5.
27(e) This section shall remain in effect only until January 1, 2015,
28and as of that date is repealed, unless a later enacted statute, that
29is enacted before January 1, 2015, deletes or extends that date.
Section 13002 is added to the Vehicle Code, to read:
(a) Except as otherwise provided in subdivision (b),
