An act to amend the Budget Act of 2012 by amending Items 0890-001-0001 and 0890-001-0228 of Section 2.00 of that act, relating to the state budget, and making an appropriation therefor, to take effect immediately, budget bill.

The Budget Act of 2012 appropriated $53,526,000 to the Secretary of State for purposes of filings and registrations during the 2012-13 fiscal year.

This bill would increase this appropriation bybegin delete $2,000,000end deletebegin insert $1,600,000end insert tobegin delete $55,526,000end deletebegin insert $55,126,000end insert. The bill would require that this increase be used for costs associated with reducing the processing time for business filings and require the Secretary of State to report on the 30th day of each month to the Joint Legislative Budget Committee on the Secretary of State’s progress in achieving those reductions.

This bill would declare that it is to take effect immediately as a Budget Bill.

Vote: majority. Appropriation: yes. Fiscal committee: yes. State-mandated local program: no.

Provisions:

 
 1.

The Secretary of State may not expend any special handling fees authorized by Chapter 999 of the Statutes of 1999 which are collected in excess of the cost of administering those special handling fees unless specifically authorized by the Legislature.

 
 2.

Of the amounts appropriated in this item, $16,602,000 shall be used for operational costs associated with implementation of the Help America Vote Act of 2002 (42 U.S.C. Sec. 15301 et seq.).

 
 3.

Of the funds appropriated in this item, $5,733,000 is available for preparing, printing, and mailing the state ballot pamphlet pursuant to Article 7 (commencing with Section 9080) of Chapter 1 of Division 9 of the Elections Code. Any unexpended funds pursuant to this provision shall revert to the General Fund.

 
 4.

Thebegin delete $2,000,000end deletebegin insert $1,600,000end insert increase to Schedule (1) made by Assembly Bill 113 of the 2013-14 Regular Session shall be used for costs associated with reducing the processing time for business filings. The Secretary of State shall report to the Joint Legislative Budget Committee on the 30th day of each month regarding the Secretary of State’s progress on reducing the processing time for business filings.

SEC. 3.  

This act is a Budget Bill within the meaning of
