BILL ANALYSIS Ó AB 141 Page 1 Date of Hearing: August 25, 2014 ASSEMBLY COMMITTEE ON TRANSPORTATION Bonnie Lowenthal, Chair AB 141 (Ammiano) - As Amended: August 6, 2014 SUBJECT : Treasure Island Mobility Management Agency SUMMARY : This bill separates legally the Treasure Island Mobility Management Agency (TIMMA) from the San Francisco County Transportation Authority (SFCTA) for purposes of implementing the Treasure Island transportation program. Specifically, this bill: 1)Renames the transportation management agency for Treasure Island the Treasure Island Mobility Management Agency (TIMMA). 2)Allows the San Francisco Board of Supervisors to revise or revoke its designation of a transportation management agency at any time. 3)Provides that TIMMA is an independent and autonomous public agency governed by the board of SFCTA or by a body the board of supervisors designates in the future. 4)Affirms that the transportation management agency is a separate and distinct legal entity that is responsible for its own obligations, debts, and liabilities. 5)Includes urgency provisions. EXISTING LAW: 1)Authorizes the San Francisco Board of Supervisors to designate a board or agency to act as the transportation management agency to adopt and implement a comprehensive transportation program for Treasure Island that will encourage public transit and bicycle, pedestrian, and waterborne modes of transportation and minimize the impact of Treasure Island development on traffic on and around the Bay Bridge. 2)Grants the transportation management agency extensive powers to implement the transportation program for Treasure Island, including the power to: AB 141 Page 2 a) Administer and collect the congestion pricing fees; b) Regulate on- and off-street parking, including adopting and collecting parking fees, fines, and penalties; c) Adopt and collect transit pass fees from residents and other users of Treasure Island; d)Use fee revenues for operation, maintenance, construction, collection and enforcement, and administration of the transportation program; and, e)Enter into contracts and agreements with governmental agencies and private parties as necessary and proper to implement its transportation program, including construction and maintenance of transportation facilities. FISCAL EFFECT : Unknown COMMENTS : The San Francisco County Board of Supervisors designated the SFCTA to assume the role as the Treasure Island transportation management agency, referred to as TIMMA. TIMMA is an independent public agency with a governing board composed of the same members of SFCTA that shares staff and other resources on a reimbursement basis. SFCTA, the bill's sponsor, is seeking to "firewall" the new responsibilities of TIMMA from SFCTA to ensure legal protection for the transportation authority and revenue protection for their local transportation taxes. Present plans anticipate that the TIMMA will initiate major financial commitments for long term contracts beginning early in 2015 and it is highly desirable for the firewall concept to be in place in 2015 to provide the necessary protection for the transportation authority and its revenue. This bill was substantially amended in the Senate and the Assembly-approved version of this bill was deleted. This bill, as amended in the Senate, has not been heard in an Assembly policy committee.
