BILL ANALYSIS Ó AB 176 Page 1 Date of Hearing: May 1, 2013 ASSEMBLY COMMITTEE ON APPROPRIATIONS Mike Gatto, Chair AB 176 (Campos) - As Amended: April 8, 2013 Policy Committee: JudiciaryVote:10 - 0 Urgency: No State Mandated Local Program: No Reimbursable: SUMMARY This bill requires police officers to enforce no-contact restraining orders when there are multiple restraining orders involving the same parties, and one of those orders is a no-contact order. FISCAL EFFECT There are no significant costs associated with this legislation. COMMENTS Purpose . According to the author, this bill seeks to provide the greatest protection to victims by requiring that in cases where there are multiple and conflicting protective orders regarding the same parties and one of those orders is a no-contact order, a law enforcement officer must enforce the no-contact order. This should help ensure that victims of domestic violence, who are protected by multiple protective orders, receive the protections ordered by the court. If none of the orders forbid contact, then enforcement priority continues as under current law. Analysis Prepared by : Julie Salley-Gray / APPR. / (916) 319-2081 AB 176 Page 2
