           SUBJECT : Business logo signs

           SOURCE : Author

DIGEST : This bill requires the Department of Transportation
(Caltrans) to allow the placement of business logo signs along
State Highway Route (SR) 65 within, or at exits leading to, the
          City of Lincoln.

ANALYSIS : Under existing law, Caltrans administers the
Business Logo Signing Program to place information signs
identifying specific roadside businesses offering fuel, food,
lodging, camping services, approved 24-hour pharmacy services,
or approved attractions near exits on freeways located in rural
areas. Any business whose primary and principal source of
                                                                CONTINUED

                                                                     AB 178
                                                                     Page

revenue is the sale of goods, products, or services that fall
within the service categories and that meets criteria
established in regulation may participate in the program.
Caltrans charges per logo a $100 annual permit fee, a $250
annual rental fee, and additional installation and service fees
as required. Existing law provides that Caltrans may not place
a new sign in an urban area designated by the United States
Census Bureau as having a population of 5,000 or more.

          This bill:

          1. Requires Caltrans to allow the placement of business logo
signs along SR 65 within, or at exits leading to, the City of
             Lincoln.

          2. Requires Caltrans, on or before January 1, 2020, report to
the transportation committees of the Senate and Assembly on
             the implementation of this bill.

          3. Requires the report to describe the implementation and any
benefits of, or concerns regarding, that implementation, and
shall include recommendations as to whether or not the period
of this program should be extended and whether or not the
authorization for information signs should be expanded to
urban areas having a population of 5,000 or more.

           Comments

Six is the limit . Business logo signs can accommodate only six
logos, and Caltrans does not install more than one sign per type
of service (i.e., food, gas, lodging). To address situations in
which there are more qualified applicants than available logo
spaces, Caltrans has developed a priority system. For lodging
and camping signs, Caltrans prioritizes businesses that are
closest to the highway. For food and fuel signs, priority is
based on a point system that values proximity to the highway and
longer hours of operation. In such situations, some businesses
are left off the signs and suffer a competitive disadvantage.

ARGUMENTS IN SUPPORT : According to the Lincoln Area Chamber
of Commerce, "Over the past 37 years the city of Lincoln has
pursued a bypass that would move State Highway 65 out of the
downtown core area. Last year, 2012, the State Highway 65
bypass around Lincoln was opened and the traffic in the downtown
core area has changed dramatically. As anticipated, the
downtown area is now more accessible to local residents and with
the future changes planned by the city we expect our business
community to benefit from these changes.

"Not surprisingly though, some of our businesses that have
depended more on pass-through traffic, such as gas stations and
food businesses, have seen a significant drop in business
revenues. This legislation will help inform travelers that
these businesses are available at the State Highway 65 exit to
Lincoln Boulevard. Our local businesses will need this help in
order to survive this change during these difficult economic
          times."
