AB 331, as amended, Garcia. Consolidation of elections.
Under existing law, whenever two or more elections are called to be held on the same day, in the same territory, or in territory that is in part the same, the elections may be consolidated. If one of the elections to be consolidated is a statewide election or a specified local election, existing law requires the consolidated election to be held and conductedbegin insert, and all other proceedings incidental to and connected with the election to be regulated and done,end insert in accordance with the provisions of law regulating the statewidebegin insert or regularly scheduledend insert election.
This bill would additionally specify that whenever an electionbegin delete called by a district, city, or other political subdivisionend delete
is consolidated with abegin delete county or statewideend deletebegin insert specialend insert election, the consolidated election shall bebegin insert held andend insert conductedbegin insert, and all other proceedings incidental to and connected with the election to be regulated and done,end insert in accordance withbegin delete the applicable procedures and practices of the county in which the election is consolidated, as determined by the county elections official, provided that the procedures and practices
are not inconsistent with the provisions of law regulating the statewide or county electionend deletebegin insert the provisions of law regulating the special electionend insert.
Under existing law, if an election called by a district, city, or other political subdivision is to be consolidated with a statewide election, as specified, the district, city, or other political subdivision must file with the board of supervisors and the county elections official a resolution of its governing board that, among other things, requests the consolidation.
This bill would require the resolution to acknowledge that the consolidated election will bebegin insert held andend insert conducted in accordance with thebegin delete applicable procedures and practices of the county in which the election is consolidated, as determined by the county elections officialend deletebegin insert
provisions of law regulating the statewide electionend insert.

The people of the State of California do enact as follows:
Section 10403 of the Elections Code is amended
2to read:
(a) Whenever an election called by a district, city, or
4other political subdivision for the submission of a question,
5proposition, or office to be filled is to be consolidated with a
6statewide election, and the question, proposition, or office to be
7filled is to appear upon the same ballot as that provided for
the
8statewide election, the district, city, or other political subdivision
9shall, at least 88 days prior to the date of the election, file with the
10board of supervisors, and a copy with the elections official, a
11resolution of its governing board that does all of the following:
12(1) Requests that the district, city, or other political subdivision
13election be consolidated with the statewide election.
14(2) Sets forth the exact form of the question, proposition, or
15office to be voted upon at the election, as it is to appear on the
16ballot. The question or proposition to appear on the ballot shall
17conform to this code governing the wording of propositions
18submitted to the voters at a statewide election.
19(3) Acknowledges that the consolidated election will bebegin insert held
20and end insertconducted in the manner prescribed in Section 10418.
21(b) The resolution requesting the consolidation shall be adopted
22and filed at the same time as the adoption of the ordinance,
23resolution, or order calling the election.

2district, city, or other political subdivision offices are to be filled
3shall be filed with the county elections official no later than 81
4days prior to the election.
Section 10418 of the Elections Code is amended to
6read:
(a) Whenever an election is to be held on the same day

14precincts designated, candidates nominated, ballots printed, polls
15opened and closed,begin insert voter challenges determined,end insert ballots counted
16and returned, returns canvassed, results declared, certificates of
17election issued,begin insert recounts conducted, election contests presented,end insert
18 and all other proceedings incidental to and connected with the
19election shall be regulated and done in accordance with the
20provisions
of law regulating thebegin delete statewide, county, or regularly begin insert statewide or specialend insert electionbegin insert, or the election held
21scheduledend delete
22pursuant to Section 1302 or 1303, as applicableend insert.
23(b) Whenever an election called by a district, city, or other
24political subdivision is consolidated with a county or statewide
25election, including a statewide special election, the
consolidated
26election shall be conducted in accordance with the applicable
27procedures and practices of the county in which the election is
28consolidated, as determined by the county elections official,
29provided that the procedures and practices are not inconsistent
30with the provisions of law regulating the statewide or county
31election.
