An act to amend Section 78212 of the Education Code, relating to community colleges.

AB 388, as introduced, Chesbro. Community colleges: Seymour-Campbell Student Success Act of 2012.

Existing law establishes the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, as one of the segments of public postsecondary education in this state.

Existing law, known as the Seymour-Campbell Student Success Act of 2012, was enacted for the purpose of increasing California community college access and success by providing effective core matriculation services of orientation, assessment and placement, counseling, and other education planning services, and academic interventions. The act specifies the responsibilities of students and institutions in entering into the matriculation process. The act requires the board of governors to develop a formula for allocating funding for the Student Success and Support Program that would be implemented under the act. The act provides that, in the 2012-13 fiscal year and each fiscal year thereafter, it is operative only if funds are specifically appropriated for its purposes.

This bill would make nonsubstantive changes in a provision of the act.

The people of the State of California do enact as follows:

SECTION 1.  

Section 78212 of the Education Code is amended
2to read:

78212.  

(a) (1) For purposes of this article, “matriculation”
4means a process that brings a college and a student into an
5agreement for the purpose of achieving the student’s educational
6goals and completing the student’s course of study. The agreement
7involves the responsibilities of both parties to attain those
8objectives through the college’s established programs, policies,
9and requirementsbegin insert,end insert including those established by the board of
10governors pursuant to Section 78215.

11(2) The institution’s responsibility under the agreement includes
12the provision of student services to provide a strong foundation
13and support for their academic success and ability to achieve their
14educational goals. The program of services funded through the
15Seymour-Campbell Student Success Act of 2012, which shall be
16known and may be cited as the Student Success and Support
17Program, shall include, butbegin delete areend deletebegin insert isend insert not necessarily limited to, all of
18the following:

19(A) Orientation services designed to provide to students, on a
20timely basis, information concerning campus procedures, academic
21expectations, financial assistance, and any other matters the college
22or district finds appropriate.

23(B) Assessment before course registration, as defined in Section
2478213.

25(C) Counseling and other education planning services, which
26shall include, but not necessarily be limited to, all of the following:

27(i) Counseling and advising.

28(ii) Assistance to students in the exploration of educational and
29career interests and aptitudes and identification of educational
30objectives, including, but notbegin insert necessarilyend insert limited to, preparation
31for transfer, associate degrees, and career technical education
32certificates and licenses.

33(iii) The provision of information, guided by sound counseling
34principles and practices, using a broad array of delivery
35mechanisms, including technology-based strategies to serve a
36continuum of student needs and abilities, that will enable students
37to make informed choices.

P3    1(iv) Development of an education plan leading to a course of
2study and guidance on course selection that is informed by, and
3related to, a student’s academic and career goals.

4(D) Referral to specialized support services as needed and
5available, including, but not necessarily limited to, federal, state,
6and local financial assistance; health services; career services;
7veteran support services; foster youth services; extended
8opportunity programs and services provided pursuant to Article 8
9(commencing with Section 69640) of Chapter 2 of Part 42 of
10Division 5; campus child care servicesbegin delete provided pursuant to Article
114 (commencing with Section 8225) of Chapter 2 of Part 6 of
12Division 1 of Title 1end delete
; programs that teach basic skills education
13and English as a second language; and disabled student services
14provided pursuant to Chapter 14 (commencing with Section 67300)
15of Part 40 of Division 5.

16(E) Evaluation of each student’s progress and referral to
17appropriate interventions for students who are enrolled in basic
18skills courses, who have not declared an educational goal as
19required, or who are on academic probation, as defined by
20standards adopted by the Board of Governors of the California
21Community Colleges and community college districts.

22(3)  The student’s responsibilities under the agreement include,
23but are not necessarily limited to, the identification of an academic
24and career goal upon application, the declaration of a specific
25course of study after a specified time period or unit accumulation,
26as defined by the board of governors, diligence in class attendance
27and completion of assigned coursework, and the completion of
28courses and maintenance of academic progress toward an
29educational goal and course of study identified in the student’s
30education plan. To ensure that students are not unfairly impacted
31by the requirements of this chapter, the board of governors shall
32establish a reasonable implementation period that is phased in as
33resources are available to provide nonexempt students with the
34core services pursuant to this section.

35(b) Funding for the Student Success and Support Program shall
36be targeted to fully implement orientation, assessment, counseling
37and advising, and other education planning services needed to
38assist a student in making an informed decision about his or her
