An act relating to pesticides.

AB 425, as introduced, Atkins. Pesticide: antifouling paint: pesticide registration: evaluation.

Existing law requires every manufacturer of, importer of, or dealer in any pesticide, except a person that sells any pesticide that has been registered by the manufacturer or wholesaler, to obtain a certificate of registration from the Department of Pesticide Regulation before the pesticide is offered for sale.

This bill would require the department, not later than February 1, 2014, to evaluate whether to register copper-based antifouling paint, and to make recommendations for appropriate mitigation measures that may be implemented to protect aquatic environments from the effects of exposure to that paint if it is registered as a pesticide. The bill would require the department, as part of that evaluation process, to determine a leach rate for copper-based antifouling paint used on recreational vessels.

The people of the State of California do enact as follows:

SECTION 1.  

Not later than February 1, 2014, the Department
2of Pesticide Regulation shall evaluate whether to register
P2    1copper-based antifouling paint, and make recommendations for
2appropriate mitigation measures that may be implemented to
3address the protection of aquatic environments from the effects of
4exposure to that paint if it is registered as a pesticide. As part of
5that evaluation, the department shall determine a leach rate for
6copper-based antifouling paint used on recreational vessels.
