An act to add Section 19604.6 to the Business and Professions Code, relating to horse racing.

AB 432, as amended, V. Manuel Pérez. Horse racing: exchange wagering.

(1) Existing law authorizes exchange wagering and authorizes the California Horse Racing Board to recover any costs associated with the licensing or regulation of exchange wagering by imposing an assessment on the exchange wagering licensee in an amount that does not exceed the reasonable costs associated with the licensing or regulation of exchange wagering.

This bill would require any racing association or racing fair receiving distributions from any exchangebegin delete provider’s exchange revenuesend deletebegin insert wagering agreementend insert to distribute abegin insert specifiedend insert portion of that revenue to the official registering agencybegin delete in a specified mannerend delete. begin insertThe bill would require the official registering agency to distribute those revenues in a specified manner. end insertBy imposing new requirements on any racing association or racing fair, the violation of which would be a crime, the bill would impose a state-mandated local program.

(2) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that no reimbursement is required by this act for a specified reason.

SECTION 1.  

Section 19604.6 is added to the Business and

Any racing association or racing fair receiving

719604.5, shall distributebegin delete a portion of saidend delete revenuebegin insert equal to 0.16
8percent of the total exchange wagering revenues generated
9pursuant to the exchange wagering agreementend insert
to the official
10registeringbegin delete agency in the manner prescribed inend deletebegin insert agency. The official
11registering agency shall distribute the funds received pursuant to
12this section in the manner prescribed in subdivisions (b) to (d),
13inclusive, ofend insert
Section 19617.2.

SEC. 2.  

No reimbursement is required by this act pursuant to
15Section 6 of Article XIII B of the California Constitution because
16the only costs that may be incurred by a local agency or school
17district will be incurred because this act creates a new crime or
18infraction, eliminates a crime or infraction, or changes the penalty
19for a crime or infraction, within the meaning of Section 17556 of
20the Government Code, or changes the definition of a crime within
21the meaning of Section 6 of Article XIII B of the California
22Constitution.
