Existing law provides for the licensure or registration and regulation of marriage and family therapists and interns by the Board of Behavioral Sciences. Under existing law, the board may issue a license to an applicant who holds a valid license from another state if, among other requirements, his or her education and supervised experience requirements are substantially similar, as specified. Under existing law, the board is required to accept education gained outside of California toward licensure requirements if it is substantially similar and the applicant completes certain coursework and training, and may accept education as substantially equivalent if it meets certain requirements, including the completion of at least 48 semester or 72 quarter units of instruction, as specified. If an applicant’s education does not contain the content or units required, the board is authorized to accept his or her education as substantially equivalent under certain circumstances. These provisions apply to applicants who apply for licensure between January 1, 2010, and December 31, 2013, and are operative until January 1, 2014.
This bill would extend the application of those provisions to December 31, 2014, and extend the operative date of those provisions to January 1, 2015.
Under existing law, for an applicant who holds a valid license from another state and who applies for licensure on or after January 1, 2014, the board may issue a license to that person if, among other requirements, his or her supervised experience and education is substantially equivalent and he or she passes the California law and ethics examination. For an applicant who does not hold a license, the board is required to accept experience and education gained outside of California toward the licensure or registration requirements if it is substantially equivalent. Under existing law, education is substantially equivalent if it meets certain requirements, including the completion of at least 60 semester or 90 quarter units of instruction and an 18-hour course in California law and professional ethics.
This bill would delay the application of those provisions to January 1, 2015.

Under existing law, the board may issue a license to an applicant who holds a valid license from another state and who applies for examination eligibility if, among other requirements, his or her education and supervised experience requirements are substantially equivalent, as specified, and may accept education as substantially equivalent if it meets certain requirements, including the completion of at least 48 semester or 72 quarter units of instruction, as specified. If an applicant’s education does not contain the content or units required, the board is authorized to accept his or her education as substantially equivalent under certain circumstances. Under existing law, the board is required to accept, for applicants who apply for examination eligibility and registration and who may or may not hold a license from another state, experience and education gained outside of California toward the licensure requirements if, among other requirements, it is substantially equivalent, as specified. The board may accept education as substantially equivalent if it meets certain requirements, including the completion of at least 48 semester or 72 quarter units of instruction. These provisions apply to applicants who apply between January 1, 2011, and December 31, 2013, and are operative until January 1, 2014.

Section 4980.72 of the Business and Professions
2Code is amended to read:
(a) This section applies to persons who are licensed
4outside of California and apply for licensure on or after January
51,begin delete 2014end deletebegin insert 2015end insert.
6(b) The board may issue a license to a person who, at the time
7of submitting an application for a license pursuant to this chapter,
8holds a valid license in good standing issued by a board of marriage
9counselor examiners, board of marriage and family therapists, or
10corresponding authority, of any state or country, if all of the
11following conditions are satisfied:
12(1) The
applicant’s education is substantially equivalent, as
13defined in Section 4980.78. The applicant’s degree title need not
14be identical to that required by Section 4980.36 or 4980.37.
15(2) The applicant complies with Section 4980.76, if applicable.
16(3) The applicant’s supervised experience is substantially
17equivalent to that required for a license under this chapter. The
18board shall consider hours of experience obtained outside of
P4 1California during the six-year period immediately preceding the
2date the applicant initially obtained the license described above.
3(4) The applicant passes the California law and ethics
4examination.
5(5) The applicant passes a clinical examination designated by
6the board. An applicant who obtained his or her license or
7registration
under another jurisdiction may apply for licensure with
8the board without taking the clinical examination if both of the
9following conditions are met:
10(A) The applicant obtained a passing score on the licensing
11examination set forth in regulation as accepted by the board.
12(B) The applicant’s license or registration in that jurisdiction is
13in good standing at the time of his or her application and has not
14been revoked, suspended, surrendered, denied, or otherwise
15restricted or encumbered as a result of any disciplinary proceeding
16brought by the licensing authority of that jurisdiction.
Section 4980.74 of the Business and Professions Code
18 is amended to read:
(a) This section applies to persons who apply for
20licensure or registration on or after January 1,begin delete 2014end deletebegin insert 2015end insert, and who
21do not hold a license as described in Section 4980.72.
22(b) The board shall accept education gained while residing
23outside of California for purposes of satisfying licensure or
24registration requirements if the education is substantially
25equivalent, as defined in Section 4980.78, and the applicant
26complies with Section 4980.76, if applicable. The applicant’s
27degree title need not be identical to that required by Section
284980.36 or 4980.37.
29(c) The board shall accept experience gained outside of
30California for purposes of satisfying licensure or registration
31requirements if the experience is substantially equivalent to that
32required by this chapter.
Section 4980.78 of the Business and Professions Code
34 is amended to read:
(a) This section applies to persons who apply for
36licensure or registration on or after January 1,begin delete 2014end deletebegin insert 2015end insert.
37(b) For purposes of Sections 4980.72 and 4980.74, education
38is substantially equivalent if all of the following requirements are
39met:
P5 1(1) The degree is obtained from a school, college, or university
2accredited by an accrediting agency recognized by the United
3States Department of Education and consists of, at a minimum, 48
4semester or 72 quarter units, including, but not limited to, both of
5the
following:
6(A) Six semester or nine quarter units of practicum, including,
7but not limited to, a minimum of 150 hours of face-to-face
8counseling.
9(B) Twelve semester or 18 quarter units in the areas of marriage,
10family, and child counseling and marital and family systems
11approaches to treatment, as specified in subparagraph (A) of
12paragraph (1) of subdivision (d) of Section 4980.36.
13(2) The applicant completes any units and course content
14requirements under subdivision (d) of Section 4980.36 not already
15completed in his or her education.
16(3) The applicant completes credit level coursework from a
17degree-granting institution that provides all of the following:
18(A) Instruction regarding the
principles of mental health
19recovery-oriented care and methods of service delivery in recovery
20model practice environments.
21(B) An understanding of various California cultures and the
22social and psychological implications of socioeconomic position.
23(C) Structured meeting with various consumers and family
24members of consumers of mental health services to enhance
25understanding of their experience of mental illness, treatment, and
26recovery.
27(D) Instruction in addiction and co-occurring substance abuse
28and mental health disorders, as specified in subparagraph (I) of
29paragraph (2) of subdivision (d) of Section 4980.36.
30(4) The applicant completes an 18-hour course in California
31law and professional ethics. The content of the course shall include,
32but not be
limited to, advertising, scope of practice, scope of
33competence, treatment of minors, confidentiality, dangerous
34patients, psychotherapist-patient privilege, recordkeeping, patient
35access to records, state and federal laws relating to confidentiality
36of patient health information, dual relationships, child abuse, elder
37and dependent adult abuse, online therapy, insurance
38reimbursement, civil liability, disciplinary actions and
39unprofessional conduct, ethics complaints and ethical standards,
40termination of therapy, standards of care, relevant family law,
P6 1therapist disclosures to patients, differences in legal and ethical
2standards in different types of work settings, and licensing law
3and licensing process.
4(5) The applicant’s degree title need not be identical to that
5required by subdivision (b) of Section 4980.36.
Section 4980.80 of the Business and Professions Code
7 is amended to read:
(a) This section applies to persons who apply for
9licensure between January 1, 2010, and December 31,begin delete 2013end deletebegin insert 2014end insert,
10inclusive.
11(b) The board may issue a license to a person who, at the time
12of application, holds a valid license issued by a board of marriage
13counselor examiners, marriage therapist examiners, or
14corresponding authority of any state, if all of the following
15requirements are satisfied:
16(1) The person has held that license for at least two years
17immediately preceding the date of application.
18(2) The education and supervised experience requirements are
19substantially the equivalent of this chapter.
20(3) The person complies with Section 4980.76, if applicable.
21(4) The person successfully completes the board administered
22licensing examinations as specified by subdivision (d) of Section
234980.40 and pays the fees specified.
24(5) The person completes all of the following coursework or
25training:
26(A) (i) An applicant who completed a two semester or three
27quarter unit course in law and professional ethics for marriage and
28family therapists that does not meet the requirements of Section
294980.41 as part of his or her qualifying degree shall complete an
3018-hour course in
California law and professional ethics that
31includes, but is not limited to, the following subjects: advertising,
32scope of practice, scope of competence, treatment of minors,
33confidentiality, dangerous patients, psychotherapist-patient
34privilege, recordkeeping, patient access to records, state and federal
35laws relating to the confidentiality of patient health information,
36dual relationships, child abuse, elder and dependent adult abuse,
37online therapy, insurance reimbursement, civil liability, disciplinary
38actions and unprofessional conduct, ethics complaints and ethical
39standards, termination of therapy, standards of care, relevant family
40law, and therapist disclosures to patients.
P7 1(ii) An applicant who has not completed a two semester or three
2quarter unit course in law and professional ethics for marriage and
3 family therapists that included areas of study as specified in Section
44980.41 as part of his or her qualifying degree, shall complete
a
5two semester or three quarter unit course in California law and
6professional ethics that includes, at minimum, the areas of study
7specified in Section 4980.41.
8(B) A minimum of seven contact hours of training or coursework
9in child abuse assessment and reporting as specified in Section 28
10and any regulations promulgated thereunder.
11(C) A minimum of 10 contact hours of training or coursework
12in human sexuality as specified in Section 25 and any regulations
13promulgated thereunder.
14(D) A minimum of 15 contact hours of training or coursework
15in alcoholism and other chemical substance dependency as
16specified by regulation.
17(E) (i) Instruction in spousal or partner abuse assessment,
18detection, and intervention. This instruction may be
taken either
19in fulfillment of other requirements for licensure or in a separate
20course.
21(ii) A minimum of 15 contact hours of coursework or training
22in spousal or partner abuse assessment, detection, and intervention
23strategies.
24(F) A minimum of a two semester or three quarter unit survey
25course in psychological testing. This course may be taken either
26in fulfillment of other requirements for licensure or in a separate
27course.
28(G) A minimum of a two semester or three quarter unit survey
29course in psychopharmacology. This course may be taken either
30in fulfillment of other requirements for licensure or in a separate
31course.
32(H) With respect to human sexuality, alcoholism and other
33chemical substance dependency, spousal or partner abuse
34assessment,
detection, and intervention, psychological testing, and
35psychopharmacology, the board may accept training or coursework
36acquired out of state.
37(c) This section shall remain in effect only until January 1,begin delete 2014end delete
38begin insert 2015end insert, and as of that date is repealed, unless a later enacted statute,
39that is enacted before January 1,begin delete 2014end deletebegin insert
2015end insert, deletes or extends
40that date.
Section 4980.90 of the Business and Professions Code
2 is amended to read:
(a) This section applies to persons who apply for
4licensure between January 1, 2010, and December 31,begin delete 2013end deletebegin insert 2014end insert,
5inclusive.
6(b) Experience gained outside of California shall be accepted
7toward the licensure requirements if it is substantially equivalent
8to that required by this chapter, if the applicant complies with
9Section 4980.76, if applicable, and if the applicant has gained a
10minimum of 250 hours of supervised experience in direct
11counseling within California while registered as an intern with the
12board. The board shall consider hours of experience obtained in
13another
state during the six-year period immediately preceding the
14applicant’s initial licensure by that state as a marriage and family
15therapist.
16(c) Education gained while residing outside of California shall
17be accepted toward the licensure requirements if it is substantially
18equivalent to the education requirements of this chapter, and if the
19applicant has completed all of the following:
20(1) A two semester or three quarter unit course in California
21law and professional ethics for marriage, family, and child
22counselors that shall include areas of study as specified in Section
234980.41.
24(2) A minimum of seven contact hours of training or coursework
25in child abuse assessment and reporting as specified in Section 28
26and any regulations promulgated thereunder.
27(3) A minimum of 10 contact hours of training or coursework
28in sexuality as specified in Section 25 and any regulations
29promulgated thereunder.
30(4) A minimum of 15 contact hours of training or coursework
31in alcoholism and other chemical substance dependency as
32specified by regulation.

34detection, and intervention. This instruction may be taken either
35in fulfillment of other educational requirements for licensure or

P9 1(6) A minimum of a two semester or three quarter unit survey
2course in psychological
testing. This course may be taken either
3in fulfillment of other requirements for licensure or in a separate

6course in psychopharmacology. This course may be taken either
7in fulfillment of other requirements for licensure or in a separate

18program primarily designed to train marriage and family therapists.
19(2) The applicant’s education meets the requirements of Section
204980.37. The degree title need not be identical to that required by
21subdivision (b) of Section 4980.37. If the applicant’s degree does
22not contain the content or the overall units required by Section
234980.37, the board may, in its discretion, accept the applicant’s
24education as substantially equivalent if the following criteria are
25satisfied:
26(A) The applicant’s degree contains the required number of
27practicum units and coursework required in the areas of marriage,
28family, and child counseling and marital and family systems
29approaches to treatment as specified in Section 4980.37.
30(B) The applicant remediates
his or her specific deficiency by
31completing the course content and the units required by Section
324980.37.
33(C) The applicant’s degree otherwise complies with this section.
34(e) This section shall remain in effect only until January 1,begin delete 2014end delete
35begin insert 2015end insert, and as of that date is repealed, unless a later enacted statute,
36that is enacted before January 1,begin delete 2014end deletebegin insert

Section 4999.57 of the Business and Professions Code
39 is amended to read:
(a) This section applies to a person who applies for
2examination eligibility or registration between January 1, 2011,

4license described in subdivision (a) of Section 4999.58.

18subdivision (c) of Section 4999.32, an 18-hour course in California
19law and professional ethics for professional clinical counselors.
20(d) For purposes of this section, the board may, in its discretion,
21accept education as substantially equivalent if the applicant’s
22education meets the requirements of Section 4999.32. If the
23applicant’s degree does not contain the content or the overall units
24required by Section 4999.32, the board may, in its
discretion, accept
25the applicant’s education as substantially equivalent if the following
26criteria are satisfied:
27(1) The applicant’s degree contains the required number of
28practicum units under paragraph (3) of subdivision (c) of Section
294999.32.
30(2) The applicant remediates his or her specific deficiency by
31completing the course content and units required by Section
324999.32.
33(3) The applicant’s degree otherwise complies with this section.
34(e) This section shall become inoperative on January 1,begin delete 2014end delete
35begin insert 2015end insert, and as of that date is repealed, unless a
later enacted statute,

Section 4999.58 of the Business and Professions Code
39 is amended to read:
(a) This section applies to a person who applies for
2examination eligibility between January 1, 2011, and December
331,begin delete 2013end deletebegin insert 2014end insert, inclusive, and who meets both of the following
4requirements:
5(1) At the time of application, holds a valid license as a
6professional clinical counselor, or other counseling license that
7allows the applicant to independently provide clinical mental health
8services, in another jurisdiction of the United States.
9(2) Has held the license described in paragraph (1) for at least
10two years
immediately preceding the date of application.
11(b) The board may issue a license to a person described in
12subdivision (a) if all of the following requirements are satisfied:
13(1) The education and supervised experience requirements of
14the other jurisdiction are substantially the equivalent of this chapter,
15as described in subdivision (e) and in Section 4999.46.
16(2) The person complies with subdivision (b) of Section 4999.40,
17if applicable.
18(3) The person successfully completes the examinations required
19by the board pursuant to paragraph (3) of subdivision (a) of Section
204999.50. An applicant who obtained his or her license or
21registration under another jurisdiction by taking a national
22examination that is required by the board may apply for licensure
23
with the board without retaking that examination if both of the
24following conditions are met:
25(A) The applicant obtained a passing score on the national
26licensing examination that is required by the board.
27(B) The applicant’s license or registration in that jurisdiction is
28in good standing at the time of his or her application and has not
29been revoked, suspended, surrendered, denied, or otherwise
30restricted or encumbered as a result of any disciplinary proceeding
31brought by the licensing authority of that jurisdiction.
32(4) The person pays the required fees.
33(c) Experience gained outside of California shall be accepted
34toward the licensure requirements if it is substantially equivalent
35to that required by this chapter. The board shall consider hours of
36
experience obtained in another state during the six-year period
37immediately preceding the applicant’s initial licensure by that state
38as a licensed professional clinical counselor.
39(d) Education gained while residing outside of California shall
40be accepted toward the licensure requirements if it is substantially
P12 1equivalent to the education requirements of this chapter, and if the
2applicant has completed the training or coursework required under
3subdivision (e) of Section 4999.32, which includes, in addition to
4the course described in subparagraph (I) of paragraph (1) of
5subdivision (c) of Section 4999.32, an 18-hour course in California
6law and professional ethics for professional clinical counselors.
7(e) For purposes of this section, the board may, in its discretion,
8accept education as substantially equivalent if the applicant’s
9education meets the requirements of Section
4999.32. If the
10applicant’s degree does not contain the content or the overall units
11required by Section 4999.32, the board may, in its discretion, accept
12the applicant’s education as substantially equivalent if the following
13criteria are satisfied:
14(1) The applicant’s degree contains the required number of
15practicum units under paragraph (3) of subdivision (c) of Section
164999.32.
17(2) The applicant remediates his or her specific deficiency by
18completing the course content and units required by Section
194999.32.
20(3) The applicant’s degree otherwise complies with this section.
21(f) This section shall become inoperative on January 1,begin delete 2014end delete
22begin insert
2015end insert, and as of that date is repealed, unless a later enacted statute,
23which is enacted before January 1,begin delete 2014end deletebegin insert 2015end insert, deletes or extends
24that date.
Section 4999.59 of the Business and Professions Code
26 is amended to read:
(a) This section applies to a person who applies for
28examination eligibility or registration between January 1, 2011,
29and December 31,begin delete 2013end deletebegin insert 2014end insert, inclusive, who meets both of the
30following requirements:
31(1) At the time of application, holds a valid license described
32in paragraph (1) of subdivision (a) of Section 4999.58.
33(2) Has held the license described in paragraph (1) for less than
34two years immediately preceding the date of application.
35(b) Experience gained outside of California shall be accepted
36toward the licensure requirements if it is substantially equivalent
37to that required by this chapter, if the applicant complies with
38Section 4999.40, if applicable, and if the applicant has gained a
39minimum of 250 hours of supervised experience in direct
40counseling within California while registered as an intern with the
P13 1board. The board shall consider hours of experience obtained in
2another state during the six-year period immediately preceding the
3applicant’s initial licensure in that state as a professional clinical
4counselor.
5(c) Education gained while residing outside of California shall
6be accepted toward the licensure requirements if it is substantially
7equivalent to the education requirements of this chapter, and if the
8applicant has completed the training or coursework required under
9subdivision (e) of Section 4999.32, which includes, in addition to
10the course
described in subparagraph (I) of paragraph (1) of
11subdivision (c) of Section 4999.32, an 18-hour course in California
12law and professional ethics for professional clinical counselors.
13(d) For purposes of this section, the board may, in its discretion,
14accept education as substantially equivalent if the applicant’s
15education meets the requirements of Section 4999.32. If the
16applicant’s degree does not contain the content or the overall units
17required by Section 4999.32, the board may, in its discretion, accept
18the applicant’s education as substantially equivalent if the following
19criteria are satisfied:
20(1) The applicant’s degree contains the required number of
21practicum units under paragraph (3) of subdivision (c) of Section
224999.32.

23(4) The applicant passes the examinations required to obtain a
24license under this chapter. An applicant who obtained his or her
25license or registration under another jurisdiction may apply for
26licensure with the board without taking the clinical examination
27if both of the
following conditions are met:
28(A) The applicant obtained a passing score on the licensing
29examination set forth in regulation as accepted by the board.
30(B) The applicant’s license or registration in that jurisdiction is
31 in good standing at the time of his or her application and has not
32been revoked, suspended, surrendered, denied, or otherwise
33restricted or encumbered as a result of any disciplinary proceeding
34brought by the licensing authority of that jurisdiction.
Section 4999.61 of the Business and Professions
36Code is amended to read:
(a) This section applies to persons who apply for
38examination eligibility or registration on or after January 1,begin delete 2014end delete

404999.60.
P15 1(b) The board shall accept education gained while residing

15(b) For purposes of Sections 4999.60 and 4999.61, education
16is substantially equivalent if all of the following requirements are
17met:
18(1) The degree is obtained from an accredited or approved
19institution, as defined in Section 4999.12, and consists of, at a
20minimum, 48 semester or 72 quarter units, including, but not
21limited to, both of the following:
22(A) Six semester or nine quarter units of practicum, including,
23but not limited to, a minimum of 280 hours of face-to-face
24counseling.
25(B) The required areas of study listed in subparagraphs (A) to
26(M), inclusive, of paragraph (1) of subdivision (c) of Section
274999.33.
28(2) The applicant completes any units and course content
29requirements under Section 4999.33 not already completed in his
30or her education.
31(3) The applicant completes credit level coursework from a
32degree-granting institution that provides all of the following:
33(A) Instruction regarding the principles of mental health
34recovery-oriented care and methods of service delivery in recovery
35model practice environments.
36(B) An understanding of various California cultures and the
37social and psychological implications of socioeconomic position.
38(C) Structured meeting with various consumers and family
39members of consumers of mental health services to enhance
P16 1understanding of their experience of mental illness, treatment, and
2recovery.
3(D) Instruction in behavioral addiction and co-occurring
4substance abuse and mental health disorders, as specified in
5subparagraph (K) of paragraph (1) of subdivision (c) of Section
64999.33.
7(4) The applicant completes, in addition to the course described
8in subparagraph (I) of paragraph (1) of subdivision (c) of Section
94999.33, an 18-hour course in California law and professional
10ethics that includes, but is not limited to, instruction in
advertising,
11scope of practice, scope of competence, treatment of minors,
12confidentiality, dangerous clients, psychotherapist-client privilege,
13recordkeeping, client access to records, state and federal laws
14relating to confidentiality of patient health information, dual
15relationships, child abuse, elder and dependent adult abuse, online
16therapy, insurance reimbursement, civil liability, disciplinary
17actions and unprofessional conduct, ethics complaints and ethical
18standards, termination of therapy, standards of care, relevant family
19law, and therapist disclosures to clients.
