Existing law provides for the licensure or registration and regulation of marriage and family therapists and internsbegin insert and professional clinical counselorsend insert by the Board of Behavioral Sciences. Under existing law, the board may issue a license to an applicant who holds a valid license from another state if, among other requirements, his or her education and supervised experience requirements are substantially similar, as specified. Under existing law,begin insert for marriage and family therapist applicants who apply for licensure or professional clinical counselor applicants who apply for examination eligibility or registration,end insert the board is required to accept education gained outside of

Section 4980.72 of the Business and Professions
2Code is amended to read:
(a) This section applies to persons who are licensed
4outside of California and apply for licensure on or after January
51, 2016.
6(b) The board may issue a license to a person who, at the time
7of submitting an application for a license pursuant to this chapter,
8holds a valid license in good standing issued by a board of marriage
9counselor examiners, board of marriage and family therapists, or
10corresponding authority, of any state or country, if all of the
11following conditions are satisfied:
12(1) The applicant’s education is substantially equivalent, as
13defined in Section 4980.78. The applicant’s degree title need not
14be
identical to that required by Section 4980.36 or 4980.37.
15(2) The applicant complies with Section 4980.76, if applicable.
16(3) The applicant’s supervised experience is substantially
17equivalent to that required for a license under this chapter.begin delete The begin insert end insert

32(A) The applicant obtained a passing score on the licensing
33examination set forth in regulation as accepted by the board.
34(B) The applicant’s license or registration in that jurisdiction is
35in good standing at the time of his or her application and has not
36been revoked, suspended, surrendered, denied, or otherwise
37restricted or encumbered as a result of any disciplinary proceeding
38brought by the licensing authority of that jurisdiction.
Section 4980.74 of the Business and Professions Code
2 is amended to read:
(a) This section applies to persons who apply for
4licensure or registration on or after January 1, 2016, and who do
5not hold a license as described in Section 4980.72.
6(b) The board shall accept education gained while residing
7outside of California for purposes of satisfying licensure or
8registration requirements if the education is substantially
9equivalent, as defined in Section 4980.78, and the applicant
10complies with Section 4980.76, if applicable. The applicant’s
11degree title need not be identical to that required by Section
124980.36 or 4980.37.
13(c) The board shall accept experience gained outside of
14California
for purposes of satisfying licensure or registration
15requirements if the experience is substantially equivalent to that
16required by this chapter.
Section 4980.78 of the Business and Professions Code
18 is amended to read:
(a) This section applies to persons who apply for
20licensure or registration on or after January 1, 2016.
21(b) For purposes of Sections 4980.72 and 4980.74, education
22is substantially equivalent if all of the following requirements are
23met:
24(1) The degree is obtained from a school, college, or university
25accredited by an accrediting agency recognized by the United
26States Department of Education and consists of, at a minimum, 48
27semester or 72 quarter units, including, but not limited to, both of
28the following:
29(A) Six semester or nine quarter units of
practicum, including,
30but not limited to, a minimum of 150 hours of face-to-face
31counseling.
32(B) Twelve semester or 18 quarter units in the areas of marriage,
33family, and child counseling and marital and family systems
34approaches to treatment, as specified in subparagraph (A) of
35paragraph (1) of subdivision (d) of Section 4980.36.
36(2) The applicant completes any units and course content
37requirements under subdivision (d) of Section 4980.36 not already
38completed in his or her education.
39(3) The applicant completes credit level coursework from a
40degree-granting institution that provides all of the following:
P6 1(A) Instruction regarding the principles of mental
health
2recovery-oriented care and methods of service delivery in recovery
3model practice environments.
4(B) An understanding of various California cultures and the
5social and psychological implications of socioeconomic position.
6(C) Structured meeting with various consumers and family
7members of consumers of mental health services to enhance
8understanding of their experience of mental illness, treatment, and
9recovery.
10(D) Instruction in addiction and co-occurring substance abuse
11and mental health disorders, as specified in subparagraph (I) of
12paragraph (2) of subdivision (d) of Section 4980.36.
13(4) The applicant completes an 18-hour course in California
14law
and professional ethics. The content of the course shall include,
15but not be limited to, advertising, scope of practice, scope of
16competence, treatment of minors, confidentiality, dangerous
17patients, psychotherapist-patient privilege, recordkeeping, patient
18access to records, state and federal laws relating to confidentiality
19of patient health information, dual relationships, child abuse, elder
20and dependent adult abuse, online therapy, insurance
21reimbursement, civil liability, disciplinary actions and
22unprofessional conduct, ethics complaints and ethical standards,
23termination of therapy, standards of care, relevant family law,
24therapist disclosures to patients, differences in legal and ethical
25standards in different types of work settings, and licensing law
26and licensing process.
27(5) The applicant’s degree title need not be identical to
that
28required by subdivision (b) of Section 4980.36.
Section 4980.80 of the Business and Professions Code
30 is amended to read:
(a) This section applies to persons who apply for
32licensure between January 1, 2010, and December 31, 2015,
33inclusive.
34(b) The board may issue a license to a person who, at the time
35of application, holds a valid license issued by a board of marriage
36counselor examiners, marriage therapist examiners, or
37corresponding authority of any state, if all of the following
38requirements are satisfied:
39(1) The person has held that license for at least two years
40immediately preceding the date of application.
P7 1(2) The education and supervised experience requirements are
2substantially
the equivalent of this chapter.
3(3) The person complies with Section 4980.76, if applicable.
4(4) The person successfully completes the board administered
5licensing examinations as specified by subdivision (d) of Section
64980.40 and pays the fees specified.
7(5) The person completes all of the following coursework or
8training:
9(A) (i) An applicant who completed a two semester or three
10quarter unit course in law and professional ethics for marriage and
11family therapists that does not meet the requirements of Section
124980.41 as part of his or her qualifying degree shall complete an
1318-hour course in California law and professional ethics that
14includes,
but is not limited to, the following subjects: advertising,
15scope of practice, scope of competence, treatment of minors,
16confidentiality, dangerous patients, psychotherapist-patient
17privilege, recordkeeping, patient access to records, state and federal
18laws relating to the confidentiality of patient health information,
19dual relationships, child abuse, elder and dependent adult abuse,
20online therapy, insurance reimbursement, civil liability, disciplinary
21actions and unprofessional conduct, ethics complaints and ethical
22standards, termination of therapy, standards of care, relevant family
23law, and therapist disclosures to patients.
24(ii) An applicant who has not completed a two semester or three
25quarter unit course in law and professional ethics for marriage and
26family therapists that included areas of study as specified in Section
274980.41 as
part of his or her qualifying degree, shall complete a
28two semester or three quarter unit course in California law and
29professional ethics that includes, at minimum, the areas of study
30specified in Section 4980.41.
31(B) A minimum of seven contact hours of training or coursework
32in child abuse assessment and reporting as specified in Section 28
33and any regulations promulgated thereunder.
34(C) A minimum of 10 contact hours of training or coursework
35in human sexuality as specified in Section 25 and any regulations
36promulgated thereunder.
37(D) A minimum of 15 contact hours of training or coursework
38in alcoholism and other chemical substance dependency as
39specified by regulation.
P8 1(E) (i) Instruction in spousal or partner abuse assessment,
2detection, and intervention. This instruction may be taken either
3in fulfillment of other requirements for licensure or in a separate
4course.
5(ii) A minimum of 15 contact hours of coursework or training
6in spousal or partner abuse assessment, detection, and intervention
7strategies.
8(F) A minimum of a two semester or three quarter unit survey
9course in psychological testing. This course may be taken either
10in fulfillment of other requirements for licensure or in a separate
11course.
12(G) A minimum of a two semester or three quarter unit survey
13course in psychopharmacology. This course may be taken either
14in fulfillment of
other requirements for licensure or in a separate
15course.
16(H) With respect to human sexuality, alcoholism and other
17chemical substance dependency, spousal or partner abuse
18assessment, detection, and intervention, psychological testing, and
19psychopharmacology, the board may accept training or coursework
20acquired out of state.
21(c) This section shall remain in effect only until January 1, 2016,
22and as of that date is repealed, unless a later enacted statute, that
23is enacted before January 1, 2016, deletes or extends that date.
Section 4980.90 of the Business and Professions Code
25 is amended to read:
(a) This section applies to persons who apply for
27licensure between January 1, 2010, and December 31, 2015,
28inclusive.
29(b) Experience gained outside of California shall be accepted
30toward the licensure requirements if it is substantially equivalent
31to that required by this chapter, if the applicant complies with
32Section 4980.76, if applicable, and if the applicant has gained a
33minimum of 250 hours of supervised experience in direct
34counseling within California while registered as an intern with the
35board. The board shall consider hours of experience obtained in
36another state during the six-year period immediately preceding the
37applicant’s initial licensure by that state as a marriage
and family
38therapist.
39(c) Education gained while residing outside of California shall
40be accepted toward the licensure requirements if it is substantially
P9 1equivalent to the education requirements of this chapter, and if the
2applicant has completed all of the following:
3(1) A two semester or three quarter unit course in California
4law and professional ethics for marriage, family, and child
5counselors that shall include areas of study as specified in Section
64980.41.
7(2) A minimum of seven contact hours of training or coursework
8in child abuse assessment and reporting as specified in Section 28
9and any regulations promulgated thereunder.
10(3) A minimum
of 10 contact hours of training or coursework
11in sexuality as specified in Section 25 and any regulations
12promulgated thereunder.
13(4) A minimum of 15 contact hours of training or coursework
14in alcoholism and other chemical substance dependency as
15specified by regulation.

17detection, and intervention. This instruction may be taken either
18in fulfillment of other educational requirements for licensure or
19in a separate course.
20(B) A minimum of 15 contact hours of coursework or training
21in spousal or partner abuse assessment, detection, and intervention

23(6) A
minimum of a two semester or three quarter unit survey
24course in psychological testing. This course may be taken either
25in fulfillment of other requirements for licensure or in a separate
26course.
27(7) A minimum of a two semester or three quarter unit survey
28course in psychopharmacology. This course may be taken either
29in fulfillment of other requirements for licensure or in a separate
30course.
31(8) With respect to human sexuality, alcoholism and other
32chemical substance dependency, spousal or partner abuse
33assessment, detection, and intervention, psychological testing, and
34psychopharmacology, the board may accept training or coursework
35acquired out of state.
36(d) For purposes of this section, the board may, in its discretion,
37accept
education as substantially equivalent if the applicant meets
38both of the following requirements:
39(1) The applicant has been granted a degree in a single integrated
40program primarily designed to train marriage and family therapists.
P10 1(2) The applicant’s education meets the requirements of Section
24980.37. The degree title need not be identical to that required by
3subdivision (b) of Section 4980.37. If the applicant’s degree does
4not contain the content or the overall units required by Section
54980.37, the board may, in its discretion, accept the applicant’s
6education as substantially equivalent if the following criteria are
7satisfied:
8(A) The applicant’s degree contains the required number of
9practicum units and coursework
required in the areas of marriage,
10family, and child counseling and marital and family systems
11approaches to treatment as specified in Section 4980.37.
12(B) The applicant remediates his or her specific deficiency by
13completing the course content and the units required by Section
144980.37.
15(C) The applicant’s degree otherwise complies with this section.
16(e) This section shall remain in effect only until January 1,
2016,
17and as of that date is repealed, unless a later enacted statute, that
18is enacted before January 1, 2016, deletes or extends that date.
Section 4999.57 of the Business and Professions Code
20 is amended to read:
(a) This section applies to a person who applies for
22examination eligibility or registration between January 1, 2011,
23and December 31, 2015, inclusive, who does not hold a license
24described in subdivision (a) of Section 4999.58.
25(b) Experience gained outside of California shall be accepted
26toward the licensure requirements if it is substantially equivalent
27to that required by this chapter, if the applicant complies with
28Section 4999.40, if applicable, and if the applicant has gained a
29minimum of 250 hours of supervised experience in direct
30counseling within California while registered as an intern with the
31board.
32(c) Education gained while residing outside of California shall
33be accepted toward the licensure requirements if it is substantially
34equivalent to the education requirements of this chapter, and if the
35applicant has completed the training or coursework required under
36subdivision (e) of Section 4999.32, which includes, in addition to
37the course described in subparagraph (I) of paragraph (1) of
38subdivision (c) of Section 4999.32, an 18-hour course in California
39law and professional ethics for professional clinical counselors.
P11 1(d) For purposes of this section, the board may, in its discretion,
2accept education as substantially equivalent if the applicant’s
3education meets the requirements of Section 4999.32. If the
4applicant’s degree does not contain the content or the overall units
5required by Section 4999.32, the board may, in its
discretion, accept
6the applicant’s education as substantially equivalent if the following
7criteria are satisfied:
8(1) The applicant’s degree contains the required number of
9practicum units under paragraph (3) of subdivision (c) of Section
104999.32.
11(2) The applicant remediates his or her specific deficiency by
12completing the course content and units required by Section
134999.32.
14(3) The applicant’s degree otherwise complies with this section.
15(e) This section shall become inoperative on January 1, 2016,
16and as of that date is repealed, unless a later enacted statute, which
17is enacted before January 1, 2016, deletes or extends that date.
Section 4999.58 of the Business and Professions Code
19 is amended to read:
(a) This section applies to a person who applies for
21examination eligibility between January 1, 2011, and December
2231, 2015, inclusive, and who meets both of the following
23requirements:
24(1) At the time of application, holds a valid license as a
25professional clinical counselor, or other counseling license that
26allows the applicant to independently provide clinical mental health
27services, in another jurisdiction of the United States.
28(2) Has held the license described in paragraph (1) for at least
29two years immediately preceding the date of application.
30(b) The
board may issue a license to a person described in
31subdivision (a) if all of the following requirements are satisfied:
32(1) The education and supervised experience requirements of
33the other jurisdiction are substantially the equivalent of this chapter,
34as described in subdivision (e) and in Section 4999.46.
35(2) The person complies with subdivision (b) of Section 4999.40,
36if applicable.
37(3) The person successfully completes the examinations required
38by the board pursuant to paragraph (3) of subdivision (a) of Section
394999.50. An applicant who obtained his or her license or
40registration under another jurisdiction by taking a national
P12 1examination that is required by the board may apply for licensure

with the board without retaking that examination if both of the
3following conditions are met:
4(A) The applicant obtained a passing score on the national
5licensing examination that is required by the board.
6(B) The applicant’s license or registration in that jurisdiction is
7in good standing at the time of his or her application and has not
8been revoked, suspended, surrendered, denied, or otherwise
9restricted or encumbered as a result of any disciplinary proceeding
10brought by the licensing authority of that jurisdiction.
11(4) The person pays the required fees.
12(c) Experience gained outside of California shall be accepted
13toward the licensure
requirements if it is substantially equivalent
14to that required by this chapter. The board shall consider hours of
15
experience obtained in another state during the six-year period
16immediately preceding the applicant’s initial licensure by that state
17as a licensed professional clinical counselor.
18(d) Education gained while residing outside of California shall
19be accepted toward the licensure requirements if it is substantially
20equivalent to the education requirements of this chapter, and if the
21applicant has completed the training or coursework required under
22subdivision (e) of Section 4999.32, which includes, in addition to
23the course described in subparagraph (I) of paragraph (1) of
24subdivision (c) of Section 4999.32, an 18-hour course in California
25law and professional ethics for professional clinical counselors.
26(e) For purposes of this section, the board may, in its discretion,
27accept
education as substantially equivalent if the applicant’s
28education meets the requirements of Section 4999.32. If the
29applicant’s degree does not contain the content or the overall units
30required by Section 4999.32, the board may, in its discretion, accept
31the applicant’s education as substantially equivalent if the following
32criteria are satisfied:
33(1) The applicant’s degree contains the required number of
34practicum units under paragraph (3) of subdivision (c) of Section
354999.32.
36(2) The applicant remediates his or her specific deficiency by
37completing the course content and units required by Section
384999.32.
39(3) The applicant’s degree otherwise complies with this section.
P13 1(f) This section shall become inoperative on January 1, 2016,
2and as of that date is repealed, unless a later enacted statute, which
3is enacted before January 1, 2016, deletes or extends that date.
Section 4999.59 of the Business and Professions Code
5 is amended to read:
(a) This section applies to a person who applies for
7examination eligibility or registration between January 1, 2011,
8and December 31, 2015, inclusive, who meets both of the following
9requirements:
10(1) At the time of application, holds a valid license described
11in paragraph (1) of subdivision (a) of Section 4999.58.
12(2) Has held the license described in paragraph (1) for less than
13two years immediately preceding the date of application.

15toward the licensure requirements if it is substantially equivalent

that required by this chapter, if the applicant complies with
17Section 4999.40, if applicable, and if the applicant has gained a
18minimum of 250 hours of supervised experience in direct
19counseling within California while registered as an intern with the
20board. The board shall consider hours of experience obtained in
21another state during the six-year period immediately preceding the
22applicant’s initial licensure in that state as a professional clinical
23counselor.
24(c) Education gained while residing outside of California shall
25be accepted toward the licensure requirements if it is substantially
26equivalent to the education requirements of this chapter, and if the
27applicant has completed the training or coursework required under
28subdivision (e) of Section 4999.32, which includes, in addition to
29the course described in subparagraph (I) of paragraph
(1) of
30subdivision (c) of Section 4999.32, an 18-hour course in California
31law and professional ethics for professional clinical counselors.
32(d) For purposes of this section, the board may, in its discretion,
33accept education as substantially equivalent if the applicant’s
34education meets the requirements of Section 4999.32. If the
35applicant’s degree does not contain the content or the overall units
36required by Section 4999.32, the board may, in its discretion, accept
37the applicant’s education as substantially equivalent if the following
38criteria are satisfied:

14(B) The applicant’s license or registration in that jurisdiction is
15in good
standing at the time of his or her application and has not
16been revoked, suspended, surrendered, denied, or otherwise
17restricted or encumbered as a result of any disciplinary proceeding
18brought by the licensing authority of that jurisdiction.
Section 4999.61 of the Business and Professions
20Code is amended to read:
(a) This section applies to persons who apply for
22examination eligibility or registration on or after January 1, 2016,
23and who do not hold a license as described in Section 4999.60.
24(b) The board shall accept education gained while residing
25outside of California for purposes of satisfying licensure or
26registration requirements if the education is substantially
27equivalent, as defined in Section 4999.62, and the applicant
28complies with subdivision (b) of Section 4999.40, if applicable.
29(c) The board shall accept experience gained outside of
30California for purposes of satisfying licensure or registration
31requirements
if the experience is substantially equivalent to that
32required by this chapter.
Section 4999.62 of the Business and Professions
34Code is amended to read:
(a) This section applies to persons who apply for
36examination eligibility or registration on or after January 1, 2016.
37(b) For purposes of Sections 4999.60 and 4999.61, education
38is substantially equivalent if all of the following requirements are
39met:
P16 1(1) The degree is obtained from an accredited or approved
2institution, as defined in Section 4999.12, and consists of, at a
3minimum, 48 semester or 72 quarter units, including, but not
4limited to, both of the following:
5(A) Six semester or nine quarter units of practicum, including,
6but not limited to,
a minimum of 280 hours of face-to-face
7counseling.
8(B) The required areas of study listed in subparagraphs (A) to
9(M), inclusive, of paragraph (1) of subdivision (c) of Section
104999.33.
11(2) The applicant completes any units and course content
12requirements under Section 4999.33 not already completed in his
13or her education.
14(3) The applicant completes credit level coursework from a
15degree-granting institution that provides all of the following:
16(A) Instruction regarding the principles of mental health
17recovery-oriented care and methods of service delivery in recovery
18model practice environments.
19(B) An
understanding of various California cultures and the
20social and psychological implications of socioeconomic position.
21(C) Structured meeting with various consumers and family
22members of consumers of mental health services to enhance
23understanding of their experience of mental illness, treatment, and
24recovery.
25(D) Instruction in behavioral addiction and co-occurring
26substance abuse and mental health disorders, as specified in
27subparagraph (K) of paragraph (1) of subdivision (c) of Section
284999.33.
29(4) The applicant completes, in addition to the course described
30in subparagraph (I) of paragraph (1) of subdivision (c) of Section
314999.33, an 18-hour course in California law and professional
32ethics that includes, but is
not limited to, instruction in advertising,
33scope of practice, scope of competence, treatment of minors,
34confidentiality, dangerous clients, psychotherapist-client privilege,
35recordkeeping, client access to records, state and federal laws
36relating to confidentiality of patient health information, dual
37relationships, child abuse, elder and dependent adult abuse, online
38therapy, insurance reimbursement, civil liability, disciplinary
39actions and unprofessional conduct, ethics complaints and ethical
P17 1standards, termination of therapy, standards of care, relevant family
2law, and therapist disclosures to clients.
