           SUMMARY  

          This bill updates existing law to allow for requests of birth,  
          death and marriage certificates using digitized images, to  
          require the use of a specified form for the acknowledgement of  
          an instrument, and to allow an informational copy of a death  
          certificate to be used to prove the death of a person for real  
          property transfer purposes.

           FISCAL EFFECT  

          Negligible state costs.

           COMMENTS  

           Rationale  .  This bill updates laws relating to vital statistics  
          in three ways.  First, the bill corrects a conflict in existing  
          law by clarifying there are single form certificates prescribed  
          by statute for acknowledgements taken in this state.  Second,  
          this bill adds digitized scanned images to the existing means  
          (in-person, mail, and fax) of requesting vital records.  

          Finally, this bill allows an informational copy of a death  
          certificate to be used for a real property transfer.  An  
          informational copy is issued by the appropriate public agency  
          but has the social security number and signature redacted and  
          includes a watermark stating, "This is not a valid document to  
          establish identity."  There has been some confusion about  
          informational copies and inconsistent handling by counties with  
          respect to their use for recording title to property.  This bill  
          is intended to clarify that an informational copy may be used  
          for real property transfer.
