           DIGEST  :    This bill transfers the California Cultural and  
          Historical Endowment (CCHE) from the California State Library to  
          the Natural Resources Agency (Agency) and allows the CCHE to  
          create a competitive grant program to support small capital  
          projects in museums and to fund that program with proceeds from  
          a new specialty license plate.

           ANALYSIS  :    Existing law, the CCHE Act, establishes the CCHE in  
          the California State Library, and provides that it is chaired by  
          the State Librarian.  Among other things, the CCHE Act

          authorizes the CCHE to make grants and loans on a competitive  
          basis to public agencies and nonprofit organizations, as  
          defined, to encourage development of California's historical and  
          cultural resources and requires the CCHE to undertake a  
          comprehensive survey of the state of cultural and historical  
          preservation, accessibility, and interpretation in California.

          This bill:

          1. This bill transfers the CCHE from the California State  
             Library to the Agency.

          2. Leaves CCHE board membership the same, but make the Agency's  
             Secretary the chair.

          3. Authorizes the CCHE to create a new competitive grant program  
             to support small capital projects in museums, as specified. 

          4. If the CCHE creates the new grant program, requires the CCHE  
             to apply, to the Department of Motor Vehicles (DMV) to create  
             a specialized license plate program whose revenue will be the  
             sole support of the new grant program.  Proceeds from the  
             plates will be deposited in the fund.

          5. Provides that once the revenues are received from the  
             specialty license plate, the grant program may only be funded  
             upon appropriation of the Legislature, through specialty  
             license plate revenues.

           Background
           
          The CCHE was established in the State Library in 2003 (AB 716,  
          Firebaugh, Chapter 1126, Statutes of 2002) to assist and enhance  
          the services of California's museums and other institutions that  
          undertake cultural projects.  The CCHE is led by a 10-member  
          board which includes the State Library (as chair), the Agency,  
          the Director of Finance, three members appointed by the  
          Governor, two members appointed by the Senate Rules Committee,  
          and two members appointed by the Assembly Speaker. 

          The CCHE Fund (Fund) is created in the Education Code Section  
          20060 and receives monies from gifts, donations, and other  
          financial support from public and private sources.  The Fund is  
          continuously appropriated to the CCHE.

          Voters approved the California Clean Water, Clean Air, Safe  
          Neighborhood Parks, and Coastal Protection Act of 2002  
          (Proposition 40), which made available monies for the  
          acquisition, restoration, preservation, and interpretation of  
          California's historical and cultural resources.  Over $120  
          million has been distributed by the CCHE to date.  In this  
          year's budget, the remaining $1.4M of Proposition 40 monies  
          reserved for historical and cultural resources was appropriated  
          to CCHE for a final year of grants under its existing grant  
          program.

          Existing law allows any state agency to apply to the DMV to  
          sponsor a specialized license plate program.  The DMV may issue  
          the new plates if certain conditions are met, including that the  
          license plate publicizes or promotes the agency or its mission,  
          at least 7,5000 applications and fees are received within a  
          24-month period, and plate revenues are exclusively for projects  
          and programs that promotes the agency's policy, mission, or  
          work.  The sponsoring state agency may use no more than 25% of  
          the place proceeds on administrative costs or marketing of the  
          specialized plate.

          According to the Senate Appropriations Committee:

           Ongoing annual costs, of approximately $400,000 for the CCHE's  
            administrative costs for the grant program.  These costs will  
            completely be borne by revenues from the specialty license  
            plate.

           One-time costs of approximately $400,000 from the Motor  
            Vehicle Account (special) to the DMV to establish a program  
            for each new plate design that meets the 7,500 application  
            threshold by January 1, 2015.  These costs will be fully  
            covered by fees paid in advance by applicants.  Ongoing DMV  
            costs to administer the issuance and renewal of the specialty  
            plate will also be fully covered by fees. 

           Unknown ongoing revenue, anticipated in the hundreds of  
            thousands to millions of dollars, to the CCHE Fund (special)  
            depending on the participation rate in the museum specialty

           ARGUMENTS IN SUPPORT  :    According to the author, "the [CCHE] is  
          winding down its grant program administering approximately $122  
          million for 180 capital projects and planning grants in the  
          state.  An opportunity has arisen for the Agency to move from  
          the State Library system to the [Agency], which would result in  
          a cost savings for both the [CCHE] and the State Library.  AB  
          482 has urgency because of the potential $30,000 in annual  
          administrative savings in moving to the [Agency]."

          A proposed special interest license plate program, "would  
          provide ongoing revenues which could be used to develop a  
          competitive grant program to support small capital projects in  
          museums, consistent with the original enabling legislation that  
          created the [CCHE]."

          "Divisions within the [Agency] have experience in overseeing and  
          managing cultural and historic properties and this move will  
          allow co-locating the [CCHE] with peer agencies that have  
          similar missions."
