BILL ANALYSIS Ó AB 501 Page 1 Date of Hearing: May 8, 2013 ASSEMBLY COMMITTEE ON APPROPRIATIONS Mike Gatto, Chair AB 501 (Nazarian) - As Amended: April 16, 2013 Policy Committee: TransportationVote:16-0 Urgency: No State Mandated Local Program: No Reimbursable: SUMMARY This bill, as proposed to be amended , makes several generally minor modifications to existing statutes related to vehicles and car dealers. Specifically, this bill: 1)Authorizes car dealers to sell non-compliant break friction materials on vehicles if the materials were already installed when the dealers acquired the vehicle. 2)Exempts car dealers from registering and reporting tire shipment activity for purposes of complying with tire recycling laws. 3)Repeals provisions requiring car dealers to place a label on a model-year 1972 through 1990 vehicle warning that the vehicle may not have lap belts and shoulder restraints. 4)Adds trailers "designed to transport watercraft" to the list of trailers exempt from motor carrier permit (MCP) requirements when towed by a certain motor truck or two-axle truck. 5)Authorizes motor trucks or two-axle trucks with a gross vehicle weight rating of 16,001 pounds or less to operate without an MCP if not being used for commercial purposes. FISCAL EFFECT Minor revenue loss to the DMV from additional exemptions to MCP permitting requirements. All other costs are negligible. AB 501 Page 2 COMMENTS Purpose . This omnibus bill, sponsored by the California New Car Dealers Association, makes several minor changes, generally to recently-enacted legislation in order to make these statutes more workable. The author's amendment removes a provision of the bill exempting specified car wash facilities, including those operated by car dealers, from a requirement to use recycled water.
