SUMMARY : Allows the Director of the Department of General
Services (DGS) to transfer title of the former Agnews
Developmental Center to the Santa Clara Unified School District
(SCUSD) for educational purposes at fair market value.
EXISTING LAW :
1)Provides for DGS to dispose of state real property that has
been identified as surplus or declared as surplus by the
Legislature.
2)Requires DGS to offer surplus real property to other state
agencies, local agencies, and private entities as provided in
statute.
3)Allows the Director of DGS to transfer surplus state real
property to a local agency for less than fair market value if
the local agency uses the surplus state real property for
parks or open-space purposes.
FISCAL EFFECT : According to the Assembly Appropriations
Committee, this bill will have negligible fiscal impact.
COMMENTS : According to the author's office, the voters within
AB 503

the SCUSD approved a general obligation bond that included
funding for the acquisition of sites for future schools. The
SCUSD is seeking to purchase part of the closed Agnews
Development Center site in north San Jose to serve K-12
students.
This bill allows, but does not require, DGS to transfer title of
the former Agnews Developmental Center to SCUSD at a fair market
value based upon a mutually acceptable value supported by an
appraisal conducted by DGS and an appraisal conducted by SCUSD.
According to the author's office, DGS continues to work with
SCUSD to reach a mutually acceptable fair market value for the
specified property.
