AB 595, as amended, Gomez. Community colleges: priority enrollment.
Existing law, the Seymour-Campbell Student Success Act of 2012, defines “matriculation” as a process that brings a college and a student into an agreement for the purpose of achieving the student’s educational goals and completing the student’s course of study. The act specifies the responsibilities of students and institutions entering into the agreement, including, among others, a student’s responsibility to identify an academic and career goal, to declare a specific course of study, and to be diligent in class attendance and the completion of assigned coursework.
This bill would state the intent of the Legislature that any student who receives priority registration for enrollmentbegin delete shall comply with the matriculation requirements ofend deletebegin insert
in an educational institution, to the extent that the institution provides specified matriculation services pursuant toend insert the Seymour-Campbell Student Success Act of 2012begin insert, shall participate in those servicesend insert.
Existing law requires the California State University and each community college district, with respect to each campus in their respective jurisdictions that administers a priority enrollment system, to grant priority in that system for registration for enrollment to any member or former member of the Armed Forces of the United States and to a foster youth or former foster youth, as provided.
This bill would require a community college district to grant priority registration for enrollment to students in the Community College Extended Opportunity Programs and Services program and to disabled studentsbegin insert who are determined to be eligible for disabled student programs and servicesend insert, as provided. The bill would make this provision inoperative on January 1, 2017.
By imposing the above requirement on a community college district, the bill would create a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

The people of the State of California do enact as follows:
Section 66025.91 is added to the Education Code,
2to read:
(a) Each community college district, with respect
4to each campus in its jurisdiction that administers a priority
5enrollment system, shall grant priority registration for enrollment
6to students in the Community College Extended Opportunity
7Programs and Services program, pursuant to Article 8
8(commencing with Section 69640), and disabled students, within
9the meaning of the federal Americans with Disabilities Act of 1990
10(42 U.S.C. Sec. 12101 etbegin delete seq.).end deletebegin insert seq.), who are determined to be
11eligible for disabled student programs and services pursuant to
12Chapter 14 (commencing with Section 67300) and Section
84850.end insert
P3 1(b) This section shall become inoperative on January 1, 2017,
2unless a later enacted statute, that is enacted before January 1,
32017, deletes or extends that date.
4(b) This section shall remain in effect only until January 1, 2017,
5and as of that date is repealed, unless a later enacted statute, that
6is enacted before January 1, 2017, deletes or extends that date.
Section 66025.95 is added to the Education Code, to
8read:
It is the intent of the Legislaturebegin delete that any student begin insert that, consistent with the requirements and intent
10who receives priority registration for enrollment shall comply with
11the requirementsend delete
12outlined in subdivisions (b) and (c) of Section 78215, and to the
13extent that the institution meets the responsibilities outlined in
14paragraph (2) of subdivision (a) of Section 78212, any student
15who receives priority registration for enrollment participate in
16the program of services outlined in paragraph (2)end insert of subdivision
17(a) of Section 78212.
If the Commission on State Mandates determines that
19this act contains costs mandated by the state, reimbursement to
20local agencies and school districts for those costs shall be made
21pursuant to Part 7 (commencing with Section 17500) of Division
224 of Title 2 of the Government Code.
