Under existing law, the Division of Boating and Waterways has powers and duties pertaining to beach erosion control, beach stabilization, and beach repair and restoration.

Existing law establishes the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Fund, available upon appropriation by the Legislature, for purposes of parks and resources improvement. The fund makes moneys available to the State Coastal Conservancy for specified purposes, including, but not limited to, the acquisition, enhancement, restoration, protection, and development of coastal resources, beaches, waterfronts, and public accessways, as specified.

This bill would appropriate $1,000,000 from the Safe Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection Bond Fund to the State Coastal Conservancy for a grant to the City of Port Hueneme. The bill would require funding to be allocated for emergency measures along Hueneme Beach in the City of Port Hueneme to prevent severe infrastructure damage to streets and property caused by beach erosion and flooding, thereby making an appropriation.

Existing law establishes the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, as one of the segments of public postsecondary education in this state. Existing law establishes community college districts, administered by governing boards, throughout the state, and authorizes these districts to provide instruction to students at the community college campuses maintained by the districts.

Existing law requires the Office of the Chancellor of the California Community Colleges to develop a statement that individual students will be asked to sign, which acknowledges that federal and state funds are available to assist with the costs of college and that information regarding these programs, and assistance in applying for those funds, can be obtained at the financial aid office.

This bill would require the Office of the Chancellor, until January 1, 2017, to establish a voluntary pilot program, with specified requirements, to increase student participation in state and federal financial aid programs and in the federal American Opportunity Tax Credit. The bill would require the Office of the Chancellor to provide specified information on the pilot program to the Legislative Analyst’s Office by January 10, 2016, which the Legislative Analyst’s Office would be required to use to report to the Legislature on the results of the pilot program and to make recommendations for statewide expansion of the pilot program.

The Legislature finds and declares all of the

3(a) Funds are needed immediately for the City of Port Hueneme
4to implement emergency measures to prevent significant damage
5caused by severe erosion at Hueneme Beach to public
6infrastructure, public roads that include a route identified by the
7Federal Emergency Management Agency as feeding into a tsunami
8evacuation route, and community areas.

9(b) These funds are also needed to prevent down coast negative
10impacts to the Ormond Beach Wetlands, a sensitive and
11ecologically important public resource, to ensure that the
12environmental quality of this unique estuary is protected.

13(c) Given the sizeable waste that remains at the Halaco
14Superfund Site, these funds are also critically needed to prevent
15downshore erosion.

Notwithstanding any other law, the sum of one million
17dollars ($1,000,000) is hereby appropriated from the Safe
18Neighborhood Parks, Clean Water, Clean Air, and Coastal
19Protection Bond Fund to the State Coastal Conservancy for a
20grant to the City of Port Hueneme. The funding shall be allocated,
21pursuant to subdivision (o) of Section 5096.310 of the Public
22Resources Code, for emergency measures to prevent severe
23infrastructure damage to streets and property located along the
24Hueneme Beach caused by beach erosion and flooding. This
25appropriation shall only be used for erosion control projects for
26which a permit has been approved by the California Coastal
27Commission.

The Legislature finds and declares that a special law
29is necessary and that a general law cannot be made applicable
30within the meaning of Section 16 of Article IV of the California
31Constitution because of the severe erosion occurring at Hueneme
32Beach that threatens public infrastructure, public roads, and
33community areas.

This act shall become operative only if Senate Bill 436
35is enacted and takes effect on or before January 1, 2014.

This act is an urgency statute necessary for the
37immediate preservation of the public peace, health, or safety within
P4    1the meaning of Article IV of the Constitution and shall go into
2immediate effect. The facts constituting the necessity are:

3To provide the necessary funding as soon as possible to
4implement emergency measures designed to prevent severe
5infrastructure damage to public infrastructure, public roads, and
6community areas threatened by flooding as a result of severe
7erosion along Hueneme Beach in the City of Port Hueneme, it is
8necessary for this measure to take effect immediately.

SECTION 1.  

Section 76072 is added to the Education Code, 10immediately following Section 76071, to read:

76072.  

(a) The Office of the Chancellor of the California
12Community Colleges shall establish a voluntary pilot program to
13increase student participation in state and federal financial aid
14programs. The chancellor shall select no more than 10 community
15college campuses to participate in the pilot program from campuses
16that volunteer to participate in the pilot program. In selecting
17campuses for the pilot program, the chancellor, to the extent
18possible, shall ensure geographic, economic, and demographic
19diversity.

20(b) The pilot program shall identify both of the following target
21populations to participate in the pilot program:

22(1) Students potentially eligible for financial aid who complete
23an application for a fee waiver provided pursuant to Section 76300,
24but who do not complete a Free Application for Federal Student
25Aid (FAFSA).

26(2) Students potentially eligible for financial aid who do not
27receive any campus, state, or federal financial aid.

28(c) The goal of the pilot program shall be to increase student
29participation in both state and federal financial aid programs by
30performing actions including, but not necessarily limited to, all of
31the following:

32(1) Identifying strategies and best practices for increasing the
33number of students who submit the FAFSA.

34(2) Examining and developing strategies for increasing student
35participation in state and federal financial aid programs beyond
36the waiver of fees pursuant to Section 76300.

37(3) Identifying the extent to which students claim the federal
38American Opportunity Tax Credit (26 U.S.C. Sec. 25A (i)) and
39developing strategies for increasing the number of students who
40claim the credit.

P5    1(d) The Office of the Chancellor of the California Community
2Colleges is encouraged to pursue both private and federal funding
3to support implementation and operation of the pilot program.

4(e) Once a pilot program has been established pursuant to
5subdivision (a), the Office of the Chancellor shall provide the
6following information to the Legislative Analyst’s Office on or
7before January 10, 2016:

8(1) Strategies and techniques that the participating community
9college campuses employed in administering the pilot program.

10(2) Data on student participation in state and federal financial
11aid programs, and to the extent possible, the American Opportunity
12Tax Credit ( 26 U.S.C. Sec. 25A (i)).

13(f) Based on the information received pursuant to subdivision
14(e), the Legislative Analyst’s Office shall report to the Legislature
15on the results of the pilot program and make recommendations for
16statewide expansion of the pilot program. The report shall include
17all of the following:

18(1) A statistical analysis of financial aid applications and awards
19before and after implementation of the pilot program.

20(2) A summary of the major strategies and techniques employed
21by the participating community college campuses in administering
22the pilot program.

23(g) This section shall remain in effect only until January 1, 2017,
24and as of that date is repealed, unless a later enacted statute, that
25is enacted before January 1, 2017, deletes or extends that date.
