    An act to add and repeal Section 76072 of the Education
Code, relating to student financial aid.   An act
relating to environmental quality, making an appropriation therefor,
and declaring the urgency thereof, to take effect immediately.

   AB 606, as amended, Williams.  Student financial aid:

protection.  
   Under existing law, the Division of Boating and Waterways has
powers and duties pertaining to beach erosion control, beach
stabilization, and beach repair and restoration.  
   Existing law establishes the Safe Neighborhood Parks, Clean Water,
Clean Air, and Coastal Protection Bond Fund, available upon
appropriation by the Legislature, for purposes of parks and resources
improvement. The fund makes moneys available to the State Coastal
Conservancy for specified purposes, including, but not limited to,
the acquisition, enhancement, restoration, protection, and
development of coastal resources, beaches, waterfronts, and public
accessways, as specified.  
   This bill would appropriate $1,000,000 from the Safe Neighborhood
Parks, Clean Water, Clean Air, and Coastal Protection Bond Fund to
the State Coastal Conservancy for a grant to the City of Port
Hueneme. The bill would require funding to be allocated for emergency
measures along Hueneme Beach in the City of Port Hueneme to prevent
severe infrastructure damage to streets and property caused by beach
erosion and flooding, thereby making an appropriation.  
   This bill would make findings and declarations as to the necessity
of a special statute for Hueneme Beach.  
   This bill would become operative only if SB 436 is enacted and
takes effect on or before January 1, 2014.  
   This bill would declare that it is to take effect immediately as
an urgency statute.  
   Existing law establishes the California Community Colleges, under
the administration of the Board of Governors of the California
Community Colleges, as one of the segments of public postsecondary
education in this state. Existing law establishes community college
districts, administered by governing boards, throughout the state,
and authorizes these districts to provide instruction to students at
the community college campuses maintained by the districts. 

   Existing law requires the Office of the Chancellor of the
California Community Colleges to develop a statement that individual
students will be asked to sign, which acknowledges that federal and
state funds are available to assist with the costs of college and
that information regarding these programs, and assistance in applying
for those funds, can be obtained at the financial aid office.
 
   This bill would require the Office of the Chancellor, until
January 1, 2017, to establish a voluntary pilot program, with
specified requirements, to increase student participation in state
and federal financial aid programs and in the federal American
Opportunity Tax Credit. The bill would require the Office of the
Chancellor to provide specified information on the pilot program to
the Legislative Analyst's Office by January 10, 2016, which the
Legislative Analyst's Office would be required to use to report to
the Legislature on the results of the pilot program and to make
recommendations for statewide expansion of the pilot program.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    The Legislature finds and declares all
of the following:  
   (a) Funds are needed immediately for the City of Port Hueneme to
implement emergency measures to prevent significant damage caused by
severe erosion at Hueneme Beach to public infrastructure, public
roads that include a route identified by the Federal Emergency
Management Agency as feeding into a tsunami evacuation route, and
community areas.  
   (b) These funds are also needed to prevent down coast negative
impacts to the Ormond Beach Wetlands, a sensitive and ecologically
important public resource, to ensure that the environmental quality
of this unique estuary is protected.  
   (c) Given the sizeable waste that remains at the Halaco Superfund
Site, these funds are also critically needed to prevent downshore
erosion. 
   SEC. 2.    Notwithstanding any other law, the sum of
one million dollars ($1,000,000) is hereby appropriated from the Safe
Neighborhood Parks, Clean Water, Clean Air, and Coastal Protection
Bond Fund to the State Coastal Conservancy for a grant to the City of
Port Hueneme. The funding shall be allocated, pursuant to
subdivision (o) of Section 5096.310 of the Public Resources Code, for
emergency measures to prevent severe infrastructure damage to
streets and property located along the Hueneme Beach caused by beach
erosion and flooding. This appropriation shall only be used for
erosion control projects for which a permit has been approved by the
California Coastal Commission. 
   SEC. 3.    The Legislature finds and declares that a
special law is necessary and that a general law cannot be made
applicable within the meaning of Section 16 of Article IV of the
California Constitution because of the severe erosion occurring at
Hueneme Beach that threatens public infrastructure, public roads, and
community areas. 
   SEC. 4.    This act shall become operative only if
Senate Bill 436 is enacted and takes effect on or before January 1,
2014. 
   SEC. 5.    This act is an urgency statute necessary
for the immediate preservation of the public peace, health, or safety
within the meaning of Article IV of the Constitution and shall go
into immediate effect. The facts constituting the necessity are:
 
   To provide the necessary funding as soon as possible to implement
emergency measures designed to prevent severe infrastructure damage
to public infrastructure, public roads, and community areas
threatened by flooding as a result of severe erosion along Hueneme
Beach in the City of Port Hueneme, it is necessary for this measure
to take effect immediately.  
  SECTION 1.    Section 76072 is added to the
Education Code, immediately following Section 76071, to read:
   76072.  (a) The Office of the Chancellor of the California
Community Colleges shall establish a voluntary pilot program to
increase student participation in state and federal financial aid
programs. The chancellor shall select no more than 10 community
college campuses to participate in the pilot program from campuses
that volunteer to participate in the pilot program. In selecting
campuses for the pilot program, the chancellor, to the extent
possible, shall ensure geographic, economic, and demographic
diversity.
   (b) The pilot program shall identify both of the following target
populations to participate in the pilot program:
   (1) Students potentially eligible for financial aid who complete
an application for a fee waiver provided pursuant to Section 76300,
but who do not complete a Free Application for Federal Student Aid
(FAFSA).
   (2) Students potentially eligible for financial aid who do not
receive any campus, state, or federal financial aid.
   (c) The goal of the pilot program shall be to increase student
participation in both state and federal financial aid programs by
performing actions including, but not necessarily limited to, all of
the following:
   (1) Identifying strategies and best practices for increasing the
number of students who submit the FAFSA.
   (2) Examining and developing strategies for increasing student
participation in state and federal financial aid programs beyond the
waiver of fees pursuant to Section 76300.
   (3) Identifying the extent to which students claim the federal
American Opportunity Tax Credit (26 U.S.C. Sec. 25A (i)) and
developing strategies for increasing the number of students who claim
the credit.
   (d) The Office of the Chancellor of the California Community
Colleges is encouraged to pursue both private and federal funding to
support implementation and operation of the pilot program.
   (e) Once a pilot program has been established pursuant to
subdivision (a), the Office of the Chancellor shall provide the
following information to the Legislative Analyst's Office on or
before January 10, 2016:
   (1) Strategies and techniques that the participating community
college campuses employed in administering the pilot program.
   (2) Data on student participation in state and federal financial
aid programs, and to the extent possible, the American Opportunity
Tax Credit ( 26 U.S.C. Sec. 25A (i)).
   (f) Based on the information received pursuant to subdivision (e),
the Legislative Analyst's Office shall report to the Legislature on
the results of the pilot program and make recommendations for
statewide expansion of the pilot program. The report shall include
all of the following:
   (1) A statistical analysis of financial aid applications and
awards before and after implementation of the pilot program.
   (2) A summary of the major strategies and techniques employed by
the participating community college campuses in administering the
pilot program.
   (g) This section shall remain in effect only until January 1,
2017, and as of that date is repealed, unless a later enacted
statute, that is enacted before January 1, 2017, deletes or extends
that date.
