An act to add Section 35013 to the Education Code, relating to school districts.

LEGISLATIVE COUNSEL’S DIGEST

AB 622, as introduced, Campos. School districts: charter school petitions: Internet posting.

Existing law authorizes one or more persons to circulate a petition for the establishment of a charter school within a school district, and authorizes the petitioners to submit the petition to the governing board of the school district for review and approval, as provided.

This bill would require a school district to post on its Internet Web site this petition. By requiring a new duty on a school district, this bill would impose a state-mandated program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: yes.

The people of the State of California do enact as follows:

SECTION 1.  

Section 35013 is added to the Education Code, 2preceding Section 35020, to read:

35013.  

A school district shall post on its Internet Web site any
4petition for the establishment of a charter school that is submitted
5to the school district for approval pursuant to Section 47605.

SEC. 2.  

If the Commission on State Mandates determines that
7this act contains costs mandated by the state, reimbursement to
8local agencies and school districts for those costs shall be made
9pursuant to Part 7 (commencing with Section 17500) of Division
104 of Title 2 of the Government Code.
