AB 622, as amended, Campos. School districts: charter school petitions: Internet posting.

Existing law authorizes one or more persons to circulate a petition for the establishment of a charter school within a school district, and authorizes the petitioners to submit the petition to the governing board of the school district for review and approval, as provided.

This bill would requirebegin delete aend deletebegin insert the petitioners to post on the proposed charter school’s Internet Web site, if one is maintained, a copy of the petition, as provided. The bill would also require aend insert school district to post on its Internet Web sitebegin delete thisend deletebegin insert a copy of theend insert petitionbegin insert and would provide that the cost to the school district, to post on its Internet Web site the petition, is to be borne by the petitionersend insert. By requiring a new duty on a school district, this bill would impose a state-mandated program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

(a) If the petitioners of a proposed charter school
5maintain an Internet Web site for the proposed charter school, the
6petitioners shall post on the proposed charter school’s Internet
7Web site a copy of the petition submitted to the school district
8pursuant to Section 47605 that contains all the information
9required in Section 47605, within five days from the date of
10submission.

SEC. 2.

19pursuant to Part 7 (commencing with Section 17500) of Division
204 of Title 2 of the Government Code.

No reimbursement is required by this act pursuant to
22Section 6 of Article XIII B of the California Constitution because
23a local agency or school district has the authority to levy service
24charges, fees, or assessments sufficient to pay for the program or
25level of service mandated by this act, within the meaning of Section
2617556 of the Government Code.
