Existing law generally regulates energy conservation and efficiency in state buildingsbegin insert, requires that all new public buildings in which energy costs exceed $10,000 per year be models of energy efficiency that are designed, constructed, and equipped with all energy efficiency measures, materials, and devices that are feasible and cost-effective over the life of the building or the life of the energy efficiency measure, and requires that all existing buildings in which energy costs exceed $10,000 per year, when renovated or remodeled, be retrofitted to meet specified standardsend insert.

A state agency, department, or commission, if it is
4evaluating the construction of a new building or facility, or the
5transfer or renewal of a lease for a building or facility, shall
6consider as a top priority in making that decision whether a
7net-zero energy consumption building or facility, also known as
8an energy-independent building or facility, can be constructed or
9occupied if that construction or occupancy can be accomplished
10at or at about the same market rate as a traditional building or
11facility, and the building or facility meets all of the location, size,
12and logistical requirements set forth in the agency’s, department’s,
13or commission’s site selection process.
It is the intent of the Legislature to require state
15agencies, departments, and commissions, when they are evaluating
16the construction of a new building or facility, or the transfer or
17renewal of a lease for a building or facility, to consider as a top
18priority in making that decision whether a net-zero energy
19consumption building or facility, also know as an
