An act to amend Section 68086 of the Government Code, relating to courtsbegin insert, and making an appropriation thereforend insert.

Existing law requires the charge of an official court reporter fee, in addition to any other fee required in civil actions or cases. For each proceeding lasting more than one hour, a fee equal to the actual cost of providing that service is required to be charged per 12 day of services to the parties, on a pro rata basis. For each proceeding lasting less than one hour, a fee of $30 is required to be charged for the reasonable cost of the services of an official court reporter. Fees collected pursuant to this provision may be used only to pay for services of an official court reporter in civil proceedings.

The bill would provide for the deposit of thebegin delete feesend deletebegin insert feeend insert collected into the Trial Court Trust Fund and would provide for the distribution ofbegin delete those feesend deletebegin insert the feeend insert back to thebegin delete courts inend deletebegin insert court fromend insert which thebegin delete fees wereend deletebegin insert fee wasend insert collectedbegin insert, thereby making an appropriationend insert. The bill would waive thebegin delete feesend deletebegin insert feeend insert for a person who has been granted a fee waiver.

SECTION 1.  

Section 68086 of the Government Code is

The following provisions apply in superior court:

4(a) In addition to any other fee required in civil actions or cases:

10(A) The fee shall be chargedbegin delete onlyend delete to the party, or parties if filing

13requests a court reporter, that party shall be charged the fee if the
14court determines that a reporter will be provided.end insert

15(B) All parties paying the fee shall deposit the fee with the clerk
16of the court as specified by the court, but not later than the
17conclusion of each day’s court session.

18(C) The fee shall be charged once per case for all proceedings
19conducted within the same hour if the total time taken by those
20proceedings is one hour or less. If the total time taken exceeds one
21hour, the fee shall be charged and collected pursuant to paragraph
22(2).

23(D) Thebegin delete feesend deletebegin insert feeend insert shall be deposited into the Trial Court Trust
24Fund and distributed back to thebegin delete courts inend deletebegin insert court fromend insert which the
25begin delete fees wereend deletebegin insert fee wasend insert collected on a dollar-for-dollar basis.

26(E) The fee shall be refundedbegin insert as soon as practicableend insert to the
27remitting party or parties if no court reporting services were
28begin delete provided at the scheduled proceeding.end deletebegin insert provided.end insert

P3    1(2) For each proceeding lasting more than one hour, a fee equal
2to the actual cost of providing that service shall be charged per
3one-half day of services to the parties, on a pro rata basis, for the
4services of an official court reporter on the first and each
5succeeding judicial day those services are provided pursuant to
6Section 269 of the Code of Civil Procedure.

7(A) All parties shall deposit their pro rata shares of these fees
8with the clerk of the court as specified by the court, but not later
9than the conclusion of each day’s court session.

10(B) For purposes of this paragraph, “one-half day” means any
11period of judicial time, in excess of one hour, but not more than
12four hours, during either the morning or afternoon court session.

13(b) The fee shall be waived for a person who has been granted
14a fee waiver under Section 68631.

15(c) The costs for the services of the official court reporter shall
16be recoverable as taxable costs by the prevailing party as otherwise
17provided by law.

18(d) The Judicial Council shall adopt rules to ensure all of the
19following:

20(1) That parties are given adequate and timely notice of the
21availability of an official court reporter.

22(2) That if an official court reporter is not available, a party may
23arrange for the presence of a certified shorthand reporter to serve
24as an official pro tempore reporter, the costs therefor recoverable
25as provided in subdivision (c).

26(3) That if the services of an official pro tempore reporter are
27utilized pursuant to paragraph (2), no other charge shall be made
28to the parties.

29(e) The fees collected pursuant to this section shall be used only
30to pay the cost for services of an official court reporter in civil
31proceedings.

32(f) The Judicial Council shall report on or before February 1 of
33each year to the Joint Legislative Budget Committee on the fees
34collected by courts pursuant to this section and Section 68086.1
35and on the total amount spent for services of official court reporters
36in civil proceedings statewide in the prior fiscal year.
