Existing law defines microenterprise as a sole proprietorship, partnership, or corporation that has fewer than 5 employees, including the owner, and generally lacks access to conventional loans, equity, or other banking services, as provided. Existing law encourages specified local agencies to access, include, and promote local partnerships that invest in microenterprise development, as provided.

This bill would expand the definition of microenterprise to include those entities that have fewer than 10 employees, including the owner, as prescribed.

Under existing law, various regulations have been promulgated with respect to the regulation of small businesses.

This bill would declare the Legislature’s intent to enact legislation that would address issues relating to small business regulations.

(a) (1) For purposes of this part, “microenterprise”
4means a sole proprietorship, partnership, or corporation that meets
5all of the following requirements:

6(A) Has fewer thanbegin delete fiveend deletebegin insert 10end insert employees, including the owner.

7(B) Is part time or full time.

8(C) Generally lacks access to conventional loans, equity, or
9other banking services.

10(2) Microenterprises are distinct from small businesses or
11microbusinesses and include, but are not limited to, businesses
12that provide child development services, businesses that provide
13landscaping services, businesses that provide building maintenance,
14businesses that provide personal and business services, businesses
15that provide specialty food products, and home-based businesses.

16(b) For purposes of this part, “microenterprise development
17provider” means a nonprofit or public agency that provides
18self-employment training, technical assistance, and access to
19microloans to individuals seeking to become self-employed or to
20expand their current business.

The Legislature intends to enact legislation that
