SUMMARY
This bill adds a retired Level I reserve peace officer to the
list of peace officers entitled to a concealed weapons (CCW)
permit if the retired reserve officer carried a gun during the
course and scope of employment and served the minimum amount of
time specified by the employing agency's policy. This policy may
not set an aggregate term requirement that is less than 10 years
or more than 20 years.
FISCAL EFFECT
Negligible fiscal impact.
COMMENTS
1)Rationale . The author and proponents, peace officer
associations, contend retired level I reserve peace officers
should be able to carry a concealed gun for protection against
persons with whom they may have had encounters with as a peace
officer.
2)Current law (a) states that peace officers in specified
designations shall have an endorsement on the officer's
identification certificate stating the issuing agency approves
the officer's carrying of a concealed weapon, (b) authorizes a
sheriff or police chief to issue a CCW upon proof of the
following:
a) The applicant is of good moral character.
b) Good cause exists for CCW issuance.
c) The person applying meets appropriate residency

requirements.
d) The person has completed the appropriate training
course, as specified.
Defines a Level I reserve peace officer as a reserve officer
deputized or appointed pursuant to specified sections, who has
completed the basic training course for deputy sheriffs and
police officers prescribed by the Commission on Peace Officer
Standards and Training.
