Existing law does not require bridges to be constructed with suicide barriers.
This bill would provide that the construction or reconstruction of a bridge designed for use by motor vehicles shall not be eligible for federal funds apportioned to the state, funds made available from the Highway Users Tax Account, or toll bridge funds unless the planning process for the bridge project takes into account the need for a suicide barrier. To the extent the bill would apply to bridges of local agencies, it would thereby impose a state-mandated local program.
The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

Section 2415 is added to the Streets and Highways
2Code, to read:
The construction or reconstruction of a bridge designed
4for use by motor vehicles shall not be eligible for federal funds
5apportioned to the state, funds made available from the Highway
6Users Tax Account, or toll bridge funds unless the planning process
7for the bridge project takes into account the need for a suicide
8barrier.
If the Commission on State Mandates determines that
10this act contains costs mandated by the state, reimbursement to
11local agencies and school districts for those costs shall be made
12pursuant to Part 7 (commencing with Section 17500) of Division
134 of Title 2 of the Government Code.
