BILL ANALYSIS Ó AB 784 Page 1 Date of Hearing: May 15, 2013 ASSEMBLY COMMITTEE ON APPROPRIATIONS Mike Gatto, Chair AB 784 (Weber) - As Amended: May 7, 2013 Policy Committee: HealthVote:13-5 Human Services 4-1 Urgency: No State Mandated Local Program: No Reimbursable: No SUMMARY This bill establishes a 13-member advisory committee to assess the impact of federal health reform on health care benefits for in-home supportive services (IHSS) providers and issue a report by March 4, 2014 on the appropriate employer under IHSS to provide health care benefits to IHSS providers under health reform. Specifies qualifications for committee members, and requires the Governor to appoint seven members and the Speaker of the Assembly and Senate Committee on Rules to each appoint three members. FISCAL EFFECT Costs to the Department of Social Services of approximately $100,000, with potentially greater costs if the advisory committee's work cannot be completed within the short time-frame allotted by this bill. COMMENTS 1)Rationale . IHSS providers assist seniors and people with disabilities who need help with daily activities, such as bathing and cooking, in order to remain safe in their own homes. According to the American Federation of State, County and Municipal Employees (AFSCME), co-sponsor of this measure, proper access to health benefits under the federal Affordable Care Act (ACA) is critical so that those who take care of other people for a living are able to help themselves as well. 2)Background: IHSS employer issues . Under IHSS law, three AB 784 Page 2 parties serve as the employer, each for a different purpose. The IHSS recipient hires and supervises the IHSS provider.
