The people of the State of California do enact as follows:
Section 2109 of the Elections Code is amended
2to read:
A person qualifies for appointment as a deputy registrar
4of voters if he or she is a registered voter of the state, or if he or
5she is a lawful permanent resident of the United States and is
P2 1otherwise eligible to register to vote
pursuant to Section 2101
2except for his or her lack of United States citizenship.
Section 12300 of the Elections Code is amended
5to read:
Any voter, or any individual who possesses the
7qualifications set forth in subdivision (c) of Section 12302, may
8file an application with the elections official for the position of
9precinct board member. The elections official may require the
10application be made on specific forms supplied by the elections
11official.
Section 12302 of the Elections Code is amended to
14read:
(a) Except as provided in subdivisions (b) and (c), a
16member of a precinct board shall be a voter of the state. The
17member may serve only in the precinct for which his or her
18appointment is received.
19(b) (1) In order to provide for a greater awareness of the
20elections process, the rights and responsibilities of voters, and the
21importance of participating in the electoral process, as well as to
22provide additional members of precinct boards, an elections official
23may appoint not more than five pupils per precinct to serve under
24the direct supervision of precinct board members designated by
25the elections official. A pupil may be
appointed, notwithstanding
26his or her lack of eligibility to vote, subject to the approval of the
27governing board of the educational institution in which the pupil
28is enrolled, if the pupil possesses the following qualifications:
29(A) Is at least 16 years of age at the time of the election for
30which he or she is serving as a member of a precinct board.
31(B) Is a United States citizen or will be a citizen at the time of
32the election for which he or she is serving as a member of a precinct
33board.
34(C) Is a pupil in good standing attending a public or private
35secondary educational institution.
36(D) Is a pupil who has a grade point average of at least 2.5 on
37a 4.0
scale.
38(2) A pupil appointed pursuant to this subdivision may not be
39used by a precinct board to tally votes.
P3 1(c) In order to promote civic engagement among residents of
2the state and to provide additional members of precinct boards, an
3elections official may appoint not more than five nonvoters per
4precinct to serve as precinct board members. A nonvoter may be
5appointed, notwithstanding his or her lack of eligibility to vote, if
6the nonvoter possesses the following qualifications:
7(1) Is a lawful permanent resident of the United States.
8(2) Is otherwise eligible to register to vote pursuant to Section
92101 except for his or her lack of United States
citizenship.
