An act to amend Section 1507.6 of the Health and Safety Code, relating to community care facilities.

LEGISLATIVE COUNSEL’S DIGEST

AB 936, as introduced, Wilk. Group homes: mental health services.

Existing law provides for child welfare services, which are public social services directed toward, among other purposes, protecting and promoting the welfare of all children, including those in foster care placement. Existing law provides for the placement of children in foster care in various settings, including group homes, by foster placement agencies, under the oversight of the State Department of Social Services. Under existing law, mental health services may be provided to a child in a group home and shall be a case management responsibility of the placing agency.

This bill would make technical, nonsubstantive changes to these provisions.

The people of the State of California do enact as follows:

SECTION 1.  

Section 1507.6 of the Health and Safety Code is

Mental health services, as deemed necessary by the
4placing agency, may be provided tobegin delete childrenend deletebegin insert a childend insert in a group
P2    1home. Except for the physical safety and direct care and supervision
2of children so placed, the State Department of Social Services and
3its agents shall not evaluate or have responsibility or liability for
4the evaluation of mental health services provided inbegin delete thoseend deletebegin insert groupend insert
5 homes. Supervision of mental health treatment services provided
6to a child in a group home shall be a case management
7responsibility of the placing agency.
