The Chacon-Moscone Bilingual-Bicultural Education Act of 1976 requires the Superintendent of Public Instruction to ensure certain aspects of bilingual education, including that sufficient bilingual personnel are available within the State Department of Education, as provided, using funds appropriated for these purposes. Under existing law, these provisions became inoperative on June 30, 1987.
This bill would make nonsubstantive changes to this law.

The people of the State of California do enact as follows:
Section 52177 of the Education Code is amended
2to read:
Out of funds appropriated for these purposes, the
4superintendent shall administer this article. The responsibilities of
5the superintendent in administering this article shall include, but
6are not limited to, ensuring all of the following:
7(a) Sufficient bilingual personnel are available within the
8department with familiarity, competency, and proficiency in
P2 1bilingual-crosscultural instruction to meet the needs of this article
2and to administer, review, monitor, and evaluate the use of state
3or federal categorical aid funds allocated to local districtsbegin delete whichend delete
4begin insert thatend insert
have been wholly or partially allocated on the basis of the
5educational needs of pupils of limited-English proficiency.
6(b) Department personnel responsible for the administration,
7review, monitoring, or evaluation of programs operating pursuant
8to this article have been sufficiently trained to carry out the intent
9of this article to meet the needs of the pupil of limited-English
10proficiency.
11(c) There is within the department an administrative unit
12responsible for bilingual-bicultural educational programs and
13policies through which the superintendent shall carry out his or
14her functions pursuant to this article.
15(d) Districts are providing each pupil of limited-English
16proficiency with an educational opportunity equal to that available
17to English-speaking pupilsbegin delete; they areend deletebegin insert,end insert
making appropriate use of
18local and state general funds to provide bilingual-crosscultural
19teachers and other required servicesbegin delete;end deletebegin insert,end insert and an annual report is made
20to the Legislature regarding the extent to which this article has
21been implemented by school districts throughout the state. All
22districts in which pupils of limited-English proficiency are enrolled
23shall be reviewed through an onsite technical assistance,
24monitoring, and enforcement process at least once every three
25years.
