Existing law authorizes the Commission on Teacher Credentialing to issue various types of teaching and services credentials, including the issuance of a multiple or single subject teaching credential. Existing law requires the Superintendent of Public Instruction to award the State Seal of Biliteracy to high school graduates who meet specified requirements, including, but not limited to, proficiency in one or more languages other than English.
This bill would require the commission to issue a foreign language teaching credential for the sole purpose of providing foreign language instruction as part of an after school program voluntarily maintained by a school district to a person who has a baccalaureate degree from an accredited institution of postsecondary education and passes the single subject California Subject Examinations for Teachers in the foreign language in which he or she will be providing instruction.
The bill would allow a high school pupil to demonstrate that he or she has proficiency in one or more languages other than English, for the purpose of being awarded the State Seal of Biliteracy, by successfully completing four years of foreign language instruction from a person issued that credential as part of an after school program voluntarily maintained by a school district.

The people of the State of California do enact as follows:
Section 44258.8 is added to the Education Code,
2to read:
Notwithstanding any other law, the commission shall
4issue a foreign language teaching credential for the sole purpose
5of providing foreign language instruction as part of an after school
6program voluntarily maintained by a school district to a person
7who meets both of the following requirements:
8(a) Passes the single subject California Subject Examinations
9for Teachers in the foreign language in which he or she will be
10providing instruction.
11(b) Has a baccalaureate degree from an accredited institution
12of postsecondary education.
Section 51461 of the Education Code is amended to
14read:
(a) The State Seal of Biliteracy certifies attainment of
16a high level of proficiency by a graduating high school pupil in
17one or more languages, in addition to English, and certifies that
18the graduate meets all of the following criteria:
19(1) Completion of all English language arts requirements for
20graduation with an overall grade point average of 2.0 or above in
21those classes.
22(2) Passing the California Standards Test in English language
23arts administered in grade 11 at the proficient level or above.
24(3) Proficiency in one or more languages other than English,
25demonstrated through one of the following methods:
26(A) Passing a foreign language Advanced Placement
27examination with a score of 3 or higher or an International
28Baccalaureate examination with a score of 4 or higher.
29(B) Successful completion of a four-year high school course of
30study in a foreign language, and attaining an overall grade point
31average of 3.0 or above in that course of study.
32(C) If no Advanced Placement examination or off-the-shelf
33language test exists and the school district can certify to the
P3 1Superintendent that the test meets the rigor of a four-year high
2school course of study in that foreign language, passing a school
3district language examination that, at a minimum, assesses
4speaking, reading, and writing in a language other than English at
5the proficient level or higher. If a school district offers a language
6examination in a language in which an

7examination or off-the-shelf language test exists, the school district
8language examination shall be approved by the Superintendent for
9the purpose of determining proficiency in a language other than
10English.
11(D) Passing the SAT II foreign language examination with a
12score of 600 or higher.
13(E) Successful completion of four years of foreign language
14instruction from a person issued a teaching credential pursuant
15to Section 44258.8 as part of an after school program voluntarily
16maintained by a school district.
17(b) If the primary language of a pupil in any of grades 9 to 12,
18inclusive, is other than English, he or she shall do both of the
19following in order to qualify for the State Seal of
Biliteracy:
20(1) Attain the early advanced proficiency level on the English
21language development test. For purposes of this paragraph, a
22participating school district may administer the English language
23development test an additional time as necessary.
24(2) Meet the requirements of subdivision (a).
25(c) For languages in which an Advanced Placement test is not
26available, the Superintendent may provide a listing of equivalent
27summative tests that school districts may use in place of an
28Advanced Placement test for purposes of subparagraph (A) of
29paragraph (3) of subdivision (a). A school district may provide the
30Superintendent with a list of equivalent summative tests that the
31district uses in place of an Advanced Placement test for purposes
32of subparagraph (A) of paragraph (3) of subdivision (a). The
33Superintendent may
use lists received from school districts in
34developing his or her list of equivalent summative tests.
35(d) For purposes of this article, “foreign language” means a
36language other than English, and includes American Sign
37Language.
