AB 1120, as amended, Hagman. Department of Justice: felony reporting: release on own recognizance.
Existing law authorizes the release of a defendant on his or her own recognizance in specified circumstances. Existing law also requires the Department of Justice to file for record and report all descriptions, information, photographs, and measurements of all persons convicted of a felony.
This bill would require the Department of Justice to collectbegin insert specifiedend insert data onbegin delete the number ofend delete individuals who are charged with a felonybegin delete and released pursuant on their own recognizance without posting bailend delete, includingbegin insert
the number of people cited and released without being booked, the number of people released on their own recognizance prior to an initial court appearance, the number of people released on alternative custody prior to making bail, andend insert the felony with which the person is charged. The bill would require the department to post this information, in aggregate, on its Internet Web site.

The people of the State of California do enact as follows:
Section 11101.5 is added to the Penal Code, to

(a) The Department of Justice shall collectbegin insert all of the
4followingend insert data onbegin delete the number ofend delete individuals who are charged with
5abegin delete felony and released pursuant to Article 9 (commencing with begin insert felony:end insert
6Section 1318) of Chapter 1 of Title 10 of Part 2 without posting
7bail, including the felony with which the person is charged.end delete
8(1) The number of people cited and released without being
9booked.
10(2) The number of people released on their own recognizance
11prior to an initial court appearance.
12(3) The number of people released on alternative custody prior
13to making bail.
14(4) For each person in the prior three paragraphs, the code
15violation for which he or she was arrested.
16(b) Information shall be acquired and compiled in a manner to
17be determined by the department and shall be published on the
18department’s Internet Web site in aggregate form. All personally
19identifiable information shall be removed.
