The existing California Tire Recycling Act requires the Department of Resources Recycling and Recovery to administer a tire recycling program, and imposes a California tire fee on a new tire purchased in the state. The revenue generated from the fee is deposited in the California Tire Recycling Management Fund for expenditure, upon appropriation by the Legislature, for the purposes of programs related to waste tires.

This bill would additionally authorize the department, when awarding grants pursuant to the tire recycling program, to award grants for public works projects to create parklets, greenways, or both, that use tire-derived products and would require the department, if it awards those grants, to give priority for funding to those projects in disadvantaged communities, as defined.

Existing law creates the Strategic Growth Council, consisting of specified state officers and a public member appointed by the Governor, with specified duties relating to coordination of actions of state agencies relative to improvement of air and water quality, natural resource protection, transportation, and various other matters.

This bill would add the Superintendent of Public Instruction or his or her designee to the Strategic Growth Council but would authorize him or her to vote only on decisions of the council that are within the jurisdiction of that office.

(a) (1) When awarding grants pursuant to Section
442872 to cities, counties, and other local government agencies for
5public works projects that use tire-derived products, the department
6may, in addition to any other authorized use of those funds, award
7grants for public works projects that use tire-derived products,
8including recycled tire lumber, to create parklets, greenways, or
9both.

10(2) If the department awards grants pursuant to this section,
11the department shall give priority to public works projects that
12use tire-derived products to create parklets, greenways, or both,
13in disadvantaged communities.

14(b) For the purposes of this section, the following terms have
15the following meanings:

16(1) “Disadvantaged community” means a community, as
17determined by the department, with an annual median household
18income that is less than 80 percent of the statewide median
19household income.

20(2) “Greenway” means a travel corridor for pedestrians,
21bicycles, nonmotorized vehicle transportation, recreation, or a
22combination thereof, located along natural landscape features,
23such as an urban watercourse.

2and that provides amenities, including, but not limited to, seating,
3tables, bicycle racks, and landscaping.

SECTION 1.  

Section 75121 of the Public Resources Code, as
5amended by Section 6 of Chapter 623 of the Statutes of 2013, is
6amended to read:

75121.  

(a) The Strategic Growth Council is hereby established
8in state government and it shall consist of the Director of State
9Planning and Research, the Secretary of the Natural Resources
10Agency, the Secretary for Environmental Protection, the Secretary
11of Transportation, the Secretary of California Health and Human
12Services, the Secretary of Business, Consumer Services, and
13Housing, the Secretary of Food and Agriculture, and one member
14of the public to be appointed by the Governor. The public member
15shall have a background in land use planning, local government,
16resource protection and management, or community development
17or revitalization.

18(b) The Superintendent of Public Instruction, or his or her
19designee, shall also be a member of the council but may vote only
20in decisions of the council that are within the jurisdiction of that
21office.

22(c) Staff for the council shall be reflective of the council’s
23membership.
