           DIGEST  :    This bill authorizes the Department of Resources  
          Recycling and Recovery (CalRecycle), when awarding grants  
          pursuant to the tire recycling program, to award grants for  
          public works projects to create parklets, greenways, or both,  
          that use tire-derived products and requires CalRecycle, if it  
          awards those grants, to give priority for funding to those  
          projects in disadvantaged communities, as defined.

           ANALYSIS  :    Existing law requires, under the California Tire  
          Recycling Act, CalRecycle to administer a tire recycling  
          program, and imposes a California tire fee on a new tire  
          purchased in the state.  The revenue generated from the fee is  
          deposited in the California Tire Recycling Management Fund for  
          expenditure, upon appropriation by the Legislature, for the  
          purposes of programs related to waste tires.

          1.Authorizes CalRecycle, when awarding grants pursuant to the  
            tire recycling program, to award grants for public works  
            projects to create parklets, greenways, or both, that use  
            tire-derived products.

          2.Requires the CalRecycle, if it awards those grants, to give  
            priority for funding to those projects in disadvantaged  
            communities, as defined.

          3.Defines the following terms for purposes of this bill:

             A.   "Disadvantaged community" means a community, as  
               determined by CalRecycle, with an annual median household  
               income that is less than 80% of the statewide median  
               household income.

             B.   "Greenway" means a travel corridor for pedestrians,  
               bicycles, non-motorized vehicle transportation, recreation,  
               or a combination thereof, located along natural landscape  
               features, such as an urban watercourse.

             C.   "Parklet" means a small urban park intended for people  
               and that provides amenities, including, but not limited to,  
               seating, tables, bicycle racks, and landscaping.

           Background
           
          Every year, millions of waste tires are generated in California;  
          unfortunately, most end up in landfills or are incinerated.  In  
          Los Angeles County alone, approximately ten million waste tires  
          are generated annually.  Waste tires that are illegally dumped  
          or improperly stored can pose a serious threat to public health  
          and safety, as well as to the environment.

          In an effort to decrease the adverse environmental impacts  
          created by the stockpiling of waste tires or otherwise unlawful  
          disposal, CalRecycle, per their authority under the California  
          Tire Recycling Act, administers the TDP Grant Program to promote  
          markets for recycled-content products derived from waste tires  
          generated in California.  However, as new products derived from  
          waste tires come to market and as new uses for those products  
          are developed, legislation is needed to ensure that CalRecycle  
          has the authority to take advantage of these innovations.

          Parklets and greenways offer respite from an often harsh urban  
          environment.  Additionally, these projects are exceedingly well  
          suited for the use of TDP.  TDP can be used to create footpaths  
          and other walkways through the use of "rubberized lumber," and  
          it is perfect for sustainable outdoor landscaping, a key  
          component of these projects.  Additionally, TDP acts as an  
          excellent playground surface, either as "pour-in-place," tiles,  
          or loose fill, all of which are well suited for use in creating  
          parklets and greenways.
