AB 1214, as introduced, Muratsuchi. Teachers: evaluation and assessment of performance.
Existing law prescribes procedures for the evaluation and assessment of performance of certificated employees and requires that any evaluation and assessment conducted pursuant to those provisions be reduced to writing with a copy transmitted to the certificated employee not later than 30 days before the last schoolday scheduled on the school calendar adopted by the governing board of the school district for the school year in which the evaluation takes place.
This bill would make nonsubstantive changes in those provisions.

The people of the State of California do enact as follows:
Section 44663 of the Education Code is amended
2to read:
(a) Evaluation and assessment made pursuant to this
4article shall bebegin delete reduced toend deletebegin insert put inend insert writing and a copy thereof shall
5be transmitted to the certificated employee not later than 30 days
6before the last schoolday scheduled on the school calendar adopted
P2 1by the governing board for the school year in which the evaluation
2takes place. The certificated employee shall have the right to
3initiate a written reaction or response to the evaluation. This
4response shall become a permanent attachment to the employee’s
5personnel file. Before the last schoolday scheduled on the school
6calendar adopted by the
governing board for the school year, a
7meeting shall be held between the certificated employee and the
8evaluator to discuss the evaluation.
9(b) In the case of a certificated noninstructional employee, who
10is employed on a 12-month basis, the evaluation and assessment
11made pursuant to this article shall bebegin delete reduced toend deletebegin insert put inend insert writing and
12a copy thereof shall be transmitted to the certificated employee no
13later than June 30 of the year in which the evaluation and
14assessment is made. A certificated noninstructional employee, who
15is employed on a 12-month basisbegin insert,end insert shall have the right to initiate a
16written reaction or response to the evaluation. This
response shall
17become a permanent attachment to the employee’s personnel file.
18Before July 30 of the year in which the evaluation and assessment
19takes place, a meeting shall be held between the certificated
20employee and the evaluator to discuss the evaluation and
21assessment.
