Existing lawbegin delete prescribes procedures for the evaluation and assessment of performance of certificated employees and requires that any evaluation and assessment conducted pursuant to those provisions be reduced to writing with a copy transmitted to the certificated employee not later than 30 days before the last schoolday scheduled on the school calendar adopted by the governing board of the school district for the school year in which the evaluation takes place.end deletebegin insert authorizes the county superintendent of schools of each county, with the consent of the State Board of Education, to establish and maintain a regional occupational center, or regional occupational program, in the county to provide education and training in career technical courses. Existing law also authorizes the governing boards of any school district maintaining high schools in the county, with the consent of the state board and county superintendent of schools, to cooperate in the establishment and maintenance of a regional occupational center or program, except as specified, and authorizes the establishment and maintenance of a regional occupational center or program by 2 or more school districtsend insertbegin insert to be undertaken pursuant to a joint powers authority. Existing law also requires the Superintendent of Public Instruction to calculate a revenue limit for each regional occupational center or program, as specified, and requires the Superintendent to apportion funds to the regional occupational center or program based on that calculation.end insert

3(a) The Southern California Regional Occupational Center
4(SoCal ROC) has been providing career technical education for
5pupils in the greater Los Angeles area since 1967.

6(b) SoCal ROC operates as a joint powers authority pursuant
7to Chapter 5 (commencing with Section 6500) of Division 7 of
8Title 1 of the Government Code, and is composed of multiple school
9districts that require a unique funding formula.

10(c) SoCal ROC operates much the same as a stand-alone school
11district, except that its sole function is to offer career technical
12education programs.

13(d) SoCal ROC provides essential and valuable career technical
14education programs and services to over 10,000 pupils annually.

15(e) SoCal ROC has prepared hundreds of thousands of pupils
16for careers in California’s ever-changing economy.

17(f) It is critical that SoCal ROC remains open to continue to
18provide valuable career technical education so it can prepare

Notwithstanding any other law, the Southern
6California Regional Occupational Center, a joint powers authority,
7shall receive an annual appropriation from the General Fund for
8purposes of providing career technical education services. The
9appropriated funds shall be apportioned directly to the Southern
10California Regional Occupational Center based on a formula
11agreed upon by the school districts participating in the joint powers
12authority.

The Legislature finds and declares that a special law
14is necessary and that a general law cannot be made applicable
15within the meaning of Section 16 of Article IV of the California
16Constitution because of the unique circumstances relating to the
17funding of the Southern California Regional Occupational Center.

SECTION 1.  

Section 44663 of the Education Code is amended
19to read:

44663.  

(a) Evaluation and assessment made pursuant to this
21article shall be put in writing and a copy thereof shall be transmitted
22to the certificated employee not later than 30 days before the last
23schoolday scheduled on the school calendar adopted by the
24governing board for the school year in which the evaluation takes
25place. The certificated employee shall have the right to initiate a
26written reaction or response to the evaluation. This response shall
27become a permanent attachment to the employee’s personnel file.
28Before the last schoolday scheduled on the school calendar adopted
29by the governing board for the school year, a meeting shall be held
30between the certificated employee and the evaluator to discuss the
31 evaluation.

32(b) In the case of a certificated noninstructional employee, who
33is employed on a 12-month basis, the evaluation and assessment
34made pursuant to this article shall be put in writing and a copy
35thereof shall be transmitted to the certificated employee no later
36than June 30 of the year in which the evaluation and assessment
37is made. A certificated noninstructional employee, who is employed
38on a 12-month basis, shall have the right to initiate a written
39reaction or response to the evaluation. This response shall become
40a permanent attachment to the employee’s personnel file. Before
P4    1July 30 of the year in which the evaluation and assessment takes
2place, a meeting shall be held between the certificated employee
3and the evaluator to discuss the evaluation and assessment.
