Existing law establishes the California Workforce Investment Board andbegin delete determines the qualifications for its membership. Existing lawbegin delete requires the council to perform certain functions and duties, including the development of a strategic initiative,end deletebegin insert authorizes the council to consult with other state agencies, other higher education representatives, local workforce investment boards, industry representatives, and philanthropic, nongovernmental, and environmental groups, as appropriate, in the development of a strategic initiativeend insert relating to the training and development of a skilled workforce to meet the needs of California’s emerging green economy.begin insert Existing law requires the board to participate in the development of various budget materials in order to ensure consistency with the strategic initiative. This bill would add the Speaker of the Assembly and the President Pro Tempore of the Senate as members of thebegin delete California Workforce Investment Board and theend delete Green Collar Jobs Council.begin insert The bill would instead authorize the council membership to include representatives from other state agencies, higher education, local workforce investment boards, industry representatives, and philanthropic, nongovernmental, and environmental groups, as appropriate. The bill would eliminate the council’s requirement to develop a strategic initiative and would require the council to develop and annually update a common framework consisting of specified elements to address workforce needs arising from changes in the energy, building and construction, transportation, and other industries impacted by state policies to reduce greenhouse gas emissions. The bill would require the council to submit the common framework and annual updates to the board for review and further action. The bill would authorize specified state entities to work with the council on the development of the common framework. The bill would require the board to participate in the development of various budget materials in order to ensure consistency with common framework. The bill would require the board to annually report to the Legislature on, among other things, the development of the common framework for workforce development. The bill would also correct an erroneous cross-reference.end insert

SECTION 1.  

Section 14012 of the Unemployment Insurance
2Code
is amended to read:

14012.  

The board shall be appointed by the Governor to assist
4in the development of the State Workforce Investment Plan and
5to carry out other functions, as described in Sectionbegin delete 14103end deletebegin insert 14013end insert.
6The board shall be comprised of the Governor and representatives
7from the following categories:

8(a) (1) The Speaker of the Assembly and the President Pro
9Tempore of the Senate.

10(2) Two members of each house of the Legislature, appointed
11by the appropriate presiding officer of each house.

P3    1(b) A majority of board members shall be representatives of
2business who:

3(1) Are owners of small and large businesses, chief executives
4or operating officers of small and large businesses, and other small
5and large business executives or employers with optimum
6policymaking or hiring authority, including members of local
7workforce investment boards.

8(2) Represent businesses with employment opportunities that
9reflect the employment opportunities of the state.

10(3) Are appointed from a group of individuals nominated by
11state business organizations and business trade associations.

12(c) Chief elected officials representing both cities and counties,
13where appropriate.

14(d) Representatives of labor organizations that are appointed to
15the board by the Governor shall have been nominated by state
16labor federations. At least 15 percent of board members shall be
17representatives of labor organizations.

18(e) Representatives of individuals and organizations that have
19experience with regard to youth activities.

20(f) Representatives of individuals and organizations that have
21experience and expertise in the delivery of workforce investment
22activities, including the Chancellor of the California Community
23Colleges, representatives of school districts, and representatives
24of community-based organizations within the state.

25(g) The lead state agency officials with responsibility for the
26programs, services, or activities that are mandatory participants in
27the one-stop system, or, where there are no lead state agency
28officials responsible for those programs, services, or activities, a
29representative with expertise relating to those programs, services,
30or activities.

31(h) Any other representatives and state agency officials as the
32Governor may designate, such as the state agency officials
33responsible for economic development and juvenile justice
34programs in the state.

35(i) Members of the board that represent organizations, agencies,
36or other entities shall be individuals with optimum policymaking
37authority within those organizations, agencies, or entities.

38(j) In making appointments to the board, the Governor shall
39consider the ethnic, race, gender, and geographic distribution of
40the state’s population, and members of the board shall represent
P4    1diverse regions of the state, including urban, rural, and suburban
2areas.

3(k) The Governor may appoint a single member to the board to
4represent multiple constituencies on the board.

5(l) The Governor shall select a chairperson for the board from
6the business representatives.

(a) The California Workforce Investment Board, in
10coordination with the department, shall participate in the
11development of Request for Proposal (RFP) language and the
12evaluation of proposals for determining grant allocations of the
13funds, as identified in Item 7100-001-0869, Schedule (4) 61.60 -
14WIA Removing Barriers for Special Needs Populations for Green
15Technology/Green Collar Jobs, and Schedule (2) 61.40 - WIA
16Growth Industries for Green Technology/Green Collar Jobs, of
17Section 2.00 of the Budget Act of 2009 (Chapter 1 of the Statutes
18of the 2009 Third Extraordinary Session), and future budget acts,
19to ensure consistency with thebegin delete green collar strategic initiativeend delete
20begin insert common frameworkend insert required to be developed by the Green Collar
21Jobs Council pursuant to Section 15002.

22(b) The board shall also annually prepare and submit to the
23Legislature a report containing all of the following information:

24(1) A list of any funds allocated, or not allocated for the purposes
25of subdivision (a), including a statement of the reasons for any
26such action.

27(2) The name of each grant recipient, and the amount allocated
28to the recipient.

Section 15002 of the Unemployment Insurance Code

(a) The California Workforce Investment Board
33(CWIB) shall establish a special committee known as the Green
34Collar Jobs Council (GCJC), comprised of the appropriate
35representatives from the CWIB existing membership, including
36the K-12 representative, the California Community Colleges
37representative, the Business, Transportation and Housing Agency
38representative, the Employment Development Department
39representative, the Speaker of the Assembly or his or her designated
40representative, the President pro Tempore of the Senate or his or

14on developing thebegin insert commonend insert framework, funding, strategies,
15programs, policies, partnerships, and opportunities necessary to
16address the growing need for a highly skilled and well-trained
17workforce to meet the needs of California’s emerging green
18economy. The GCJC shall do all of the following:

19(1) Assist in identifying and linking green collar job
20opportunities with workforce development training opportunities
21in local workforce investment areas (LWIAs), encouraging regional
22collaboration among LWIAs to meet regional economic demands.

23(2) Align workforce development activities with regional
24economic recovery and growth strategies.

25(3) Develop public, private, philanthropic, and nongovernmental
26partnerships to build and expand the state’s workforce development
27programs, network, and infrastructure.

28(4) Provide policy guidance for job training programs for the
29clean and green technology sectors to help them prepare specific
30populations, such as at-risk youth, displaced workers, veterans,
31formerly incarcerated individuals, and others facing barriers to
32employment.

33(5) Develop, collect, analyze, and distribute statewide and
34regional labor market data on California’s new and emerging green
35industries workforce needs, trends, and job growth.

36(6) Collaborate with community colleges and other educational
37institutions,begin delete registeredend deletebegin insert state-approvedend insert apprenticeship programs,
38business and labor organizations, and community-based and
39philanthropic organizations to align workforce development
40services with strategies for regional economic growth.

2how to expand and leverage these funds.

27needs arising from changes in the energy, building and
28construction, transportation, and other industries impacted by
29state policies to reduce greenhouse gas emissions.

30(2) The GCJC shall submit the common framework and annual
31updates to the CWIB for review and further action consistent with
32Section 14013.

33(3) The state entities described in paragraph (4) may work with
34the GCJC to develop the common framework for workforce
35development.

36(4) Participating state entities may include the State Air
37Resources Board, the California Environmental Protection Agency,
38the Public Utilities Commission, the State Energy Resources
39Conservation and Development Commission, the Business,
40Transportation and Housing Agency, the Department of Housing

2Development Agency, the Department of Food and Agriculture,
3the Office of the Chancellor of the California Community Colleges,
4the Office of the Superintendent of Public Instruction, and the
5Governor’s Office of Business and Economic Development.

6(5) Representatives from the participating state entities
7described in paragraph (4) shall be executive level representatives
8with policymaking authority.

9(6) At minimum, the common framework shall include elements
10that are critical to good jobs and quality workforce development
11outcomes, including, but not limited to, all of the following:

12(A) Responsible contractor requirements that ensure good jobs
13and skilled workers.

14(B) Guidance for connecting disadvantaged communities and
15other target populations, including veterans, to jobs created by
16investments to reduced greenhouse gas emissions.

17(C) Workforce standards to ensure high-quality work.

18(D) Mechanisms that ensure training results in industry-valued
19certificates or credentials, college credit, placements in
20state-approved apprenticeship programs, and other similar
21outcomes.

23investments.

24(F) Guidance for tracking and reporting training outcomes.
