An act to amend Section 203 of the Code of Civil Procedure, relating to jury duty.

AB 1401, as introduced, Committee on Judiciary. Jury duty: eligibility.

Existing law provides that all persons are eligible and qualified to be prospective trial jurors, except persons who, among other things, are not citizens of the United States, are not residents of the jurisdiction they are summoned to serve, or are not posessed of sufficient knowledge of the English language, as specified.

This bill would make technical, nonsubstantive changes to these provisions.

Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no.

The people of the State of California do enact as follows:

SECTION 1.  

Section 203 of the Code of Civil Procedure is
2amended to read:

203.  

(a) All persons are eligible and qualified to be prospective
4trial jurors, except the following:

5(1) Persons who are not citizens of the United States.

6(2) Persons who are less than 18 years of age.

P2    1(3) Persons who are not domiciliaries of the State of California,
2as determined pursuant to Article 2 (commencing with Section
32020) of Chapter 1 of Division 2 of the Elections Code.

4(4) Persons who are not residents of the jurisdictionbegin delete whereinend delete
5 they are summoned to serve.

6(5) Persons who have been convicted of malfeasance in office
7or a felony, and whose civil rights have not been restored.

8(6) Persons who are not possessed of sufficient knowledge of
9the English language, provided that no person shall be deemed
10incompetent solely because of the loss of sight or hearing in any
11degree or other disabilitybegin delete whichend deletebegin insert thatend insert impedes the person’s ability
12to communicate orbegin delete whichend deletebegin insert thatend insert impairs or interferes with the
13person’s mobility.

14(7) Persons who are serving as grand or trial jurors in any court
15of this state.

16(8) Persons who are the subject of conservatorship.

17(b) No person shall be excluded from eligibility for jury service
18in the State of California, for any reason other than those reasons
19provided by this section.
