ASSEMBLY COMMITTEE ON ACCOUNTABILITY AND ADMINISTRATIVE REVIEW
Jim Frazier, Chair
AB 1415 (Committee on Accountability & Administrative Review) -
As Introduced: March 20, 2013
SUBJECT : Administrative Procedures: regulations:
determinations: judicial
SUMMARY : The Office of Administrative Law (OAL) reviews all
rules, regulations and orders, and any revisions to those rules,
regulations and orders that any state agency may use to
administer its statutory authority. If the OAL finds that a
regulation adopted by an agency has not gone through the
appropriate procedures and been filed with the Secretary of
State, it may issue a public determination on the status of the
regulation.
This bill extends from 30 days to 45 days the time any
interested person has to obtain judicial review of a given
determination by filing a written petition requesting that the
determination of the OAL be modified or set aside.
FISCAL EFFECT : Unknown
COMMENTS : This bill is intended to increase access and
transparency in the regulation and rule making process.
Extending the filing deadline from 30 to 45 days will allow more
time for an interested party to both identify an OAL
determination and to file a written petition requesting that the
determination of the OAL be modified or set aside.
