DESCRIPTION
This bill extends from 30 days to 45 days the time any
interested person has to obtain judicial review of a given
determination by filing a written petition requesting that
the determination of the OAL be modified or set aside.
EXISTING LAW
The Office of Administrative Law (OAL) reviews all rules,
regulations and orders, and any revisions to those rules,
regulations and orders that any state agency may use to
administer its statutory authority. If the OAL finds that a
regulation adopted by an agency has not gone through the
appropriate procedures and been filed with the Secretary of
State, it may issue a public determination on the status of
the regulation.
BACKGROUND
According to the author's office, this bill is intended to
increase access and transparency in the regulation and rule
making process. Extending the filing deadline from 30 to 45
days will allow more time for an interested party to both
