An act to amend Section 71000 of the Education Code, relating to community colleges.

AB 1557, as introduced, Holden. Board of Governors of the California Community Colleges: student member.

Existing law establishes the California Community Colleges, under the administration of the Board of Governors of the California Community Colleges, as one of the segments of public postsecondary education in this state. The board of governors consists of 16 voting members, which include one voting student member and one nonvoting student member.

This bill would add to the board of governors one voting student member who is a member or former member of the Armed Forces of the United States. The bill would also add one voting member who is a member or former member of the Armed Forces of the United States who has demonstrated expertise and leadership in the field of veterans’ affairs.

SECTION 1.  

Section 71000 of the Education Code is amended

There is in the state government a Board of Governors
4of the California Community Colleges, consisting ofbegin delete 16end deletebegin insert 18end insert voting

6(a) Twelve members, each appointed by the Governor with the
7advice and consent of two-thirds of the membership of the Senate
8to six-year staggered terms. Two of these members shall be current
9or former elected members of local community college district
10governing boards.

13with the procedure set forth in paragraph (3).

14(ii) One voting student member who is a member or former
15member of the Armed Forces of the United States, as defined in
16subdivision (e) of Section 66025.8. For a voting student member
17appointed pursuant to this clause, all of the following apply:

18(I) For the purposes of subclauses (II), (III), and (IV), a
19 “member” means a voting student member appointed pursuant to
20this clause.

21(II) A member may exercise the same privileges of a voting
22student member serving a second year term appointed pursuant
23to clause (i).

24(III) If a member resigns or the office is otherwise vacant, a
25voting student member who is a member or former member of the
26Armed Forces of the United States, as defined in subdivision (e)
27of Section 66025.8, and who meets the requirements of
28subparagraph (B) shall be appointed by the Governor pursuant
29to subparagraph (C).

30(IV) A member is exempt from paragraphs (2) and (4), and
31exempt from paragraph (3), except as provided by subclause (II).

32(B) A student member shall be enrolled in a community college
33with a minimum of five semester units, or its equivalent, at the
34time of the appointment and throughout the period of his or her
35term, or until a replacement has been named. A student member
36shall be enrolled in a community college at least one semester
37before his or her appointment, and shall meet and maintain the
P3    1minimum standards of scholarship prescribed for community
2college students.

3(C) Each student member shall be appointed by the Governor
4from a list of names of at least three eligible persons submitted to
5the Governor by the student organization recognized by the board
6of governors.

7(2) The term of office of one student member of the board shall
8commence on July 1 of an even-numbered year, and expire on
9June 30 two years thereafter. The term of office of the other student
10member of the board shall commence on July 1 of an
11odd-numbered year, and expire on June 30 two years thereafter.
12Notwithstanding paragraph (1), a student member who graduates
13from his or her college on or after January 1 of the second year of
14his or her term of office may serve the remainder of the term.

15(3) During the first year of a student member’s term, a student
16member shall be a member of the board and may attend all
17meetings of the board and its committees. At these meetings, a
18student member may fully participate in discussion and debate,
19but shall not vote. During the second year of a student member’s
20term, a student member may exercise the same right to attend
21meetings of the board, and its committees, and shall have the same
22right to vote as the members appointed pursuant to subdivisions
23(a) and (c).

24(4) Notwithstanding paragraph (3), if a student member resigns
25from office or a vacancy is otherwise created in that office during
26the second year of a student member’s term, the remaining student
27member shall immediately assume the office created by the vacancy
28and all of the participation privileges of the second-year student
29member, including the right to vote, for the remainder of that term
30of office.

31(c) Two voting tenured faculty members from a community
32college, who shall be appointed by the Governor for two-year
33terms. The Governor shall appoint each faculty member from a
34list of names of at least three eligible persons furnished by the
35Academic Senate of the California Community Colleges. Each
36seat designated as a tenured faculty member seat shall be filled by
37a tenured faculty member from a community college pursuant to
38this section and Section 71003.

39(d) One voting classified employee, who shall be appointed by
40the Governor for a two-year term. The Governor shall appoint the
P4    1classified employee member from a list of at least three eligible
2persons furnished by the exclusive representatives of classified
3employees of the California Community Colleges.

4(e) One voting member who is a member or former member of
5the Armed Forces of the United States, as defined in subdivision
6(e) of Section 66025.8, who has demonstrated expertise and
7leadership in the field of veterans’ affairs.
