12Community Colleges, a member of the board should embrace the
13basic role and responsibility of a member of the board to bring
14his or her own best thinking and personal views to the board’s
15discussion, determining his or her own position on each issue
16rather than being bound to represent or advocate for the positions
17of a particular organization or constituency.

SECTION 1.  

Section 71000 of the Education Code is amended
19to read:

71000.  

There is in the state government a Board of Governors
2of the California Community Colleges, consisting of 17 voting
3members and two nonvoting members, as follows:

4(a) (1) Twelve members, each appointed by the Governor with
5the advice and consent of two-thirds of the membership of the
6Senate to six-year staggered terms.

7(2) Two of the 12 members shall be current or former elected
8members of local community college district governing boards.

9(3) Commencing with the first vacancy after the operative date
10of the bill adding this paragraph that is not filled pursuant to
11paragraph (2), at least one of the 12 members shall be a member
12or former member of the Armed Forces of the United States, as
13defined in subdivision (e) of Section 66025.8, who has
14demonstrated expertise and leadership in the field of veterans’
15affairs.

16(b) (1) (A) (i) One voting student member and one nonvoting
17student member, who exercise their duties in accordance with the
18procedure set forth in paragraph (3).

19(ii) In addition to the student members specified in clause (i),
20one voting student member and one nonvoting student member,
21each of whom is a member or former member of the Armed Forces
22of the United States, as defined in subdivision (e) of Section
23 66025.8, who shall be appointed by the Governor for a two-year
24term from a list of names of at least three eligible persons submitted
25to the Governor by the student organization recognized by the
26board, and who shall exercise their duties in accordance with the
27procedure set forth in paragraph (3).

28(B) A student member shall be enrolled in a community college
29with a minimum of five semester units, or its equivalent, at the
30time of the appointment and throughout the period of his or her
31term, or until a replacement has been named. A student member
32shall be enrolled in a community college at least one semester
33before his or her appointment, and shall meet and maintain the
34minimum standards of scholarship prescribed for community
35college students.

36(C) Each student member pursuant to clause (i) of subparagraph
37(A) shall be appointed by the Governor from a list of names of at
38least three eligible persons submitted to the Governor by the student
39organization recognized by the board of governors.

P4    1(2) The terms of office of one student member of the board
2pursuant to clause (i) of subparagraph (A) of paragraph (1), and
3one student member of the board pursuant to clause (ii) of
4subdivision (A) of paragraph (1) shall commence on July 1 of an
5even-numbered year, and expire on June 30 two years thereafter.
6The terms of office of the other student members of the board shall
7commence on July 1 of an odd-numbered year, and expire on June
830 two years thereafter. Notwithstanding paragraph (1), a student
9member who graduates from his or her college on or after January
101 of the second year of his or her term of office may serve the
11remainder of the term.

12(3) During the first year of a student member’s term, a student
13member shall be a member of the board and may attend all
14meetings of the board and its committees. At these meetings, a
15student member may fully participate in discussion and debate,
16but shall not vote. During the second year of a student member’s
17term, a student member may exercise the same right to attend
18meetings of the board, and its committees, and shall have the same
19right to vote as the members appointed pursuant to subdivisions
20(a) and (c).

21(4) Notwithstanding paragraph (3), if a student member resigns
22from office or a vacancy is otherwise created in that office during
23the second year of a student member’s term, the remaining student
24member shall immediately assume the office created by the vacancy
25and all of the participation privileges of the second-year student
26member, including the right to vote, for the remainder of that term
27of office.

28(c) Two voting tenured faculty members from a community
29college, who shall be appointed by the Governor for two-year
30terms. The Governor shall appoint each faculty member from a
31list of names of at least three eligible persons furnished by the
32Academic Senate of the California Community Colleges. Each
33seat designated as a tenured faculty member seat shall be filled by
34a tenured faculty member from a community college pursuant to
35this section and Section 71003.

36(d) One voting classified employee, who shall be appointed by
37the Governor for a two-year term. The Governor shall appoint the
38classified employee member from a list of at least three eligible
39persons furnished by the exclusive representatives of classified
40employees of the California Community Colleges.

SEC. 2.  

It is the intent of the Legislature that there be 16 voting
2members on the Board of Governors of the California Community
3Colleges until the first student member appointed to a position
4established by this act serves one year in office.
