An act to add Section 8753.6 to the Government Code, relating to state government, and making an appropriation therefor.

LEGISLATIVE COUNSEL’S DIGEST

AB 1625, as introduced, Nazarian. California Arts Council Contribution and Donations Fund.

Existing law establishes the Arts Council to consist of 11 appointed members, sets forth the duties of the council, and authorizes the council to receive moneys for the purpose of promoting arts in the state. Existing law does not establish a specific fund into which these moneys are to be deposited.

Existing law establishes the Special Deposit Fund in the State Treasury consisting of moneys paid in trust to fulfill the purposes for which payments are made. Within the Special Deposit Fund there is the Art Council Donations Account.

This bill would establish the California Arts Council Contribution and Donations Fund to receive moneys donated to the Arts Council. This bill would also transfer any moneys in the Art Council Donations Account into this new fund.

This bill would make a continuous appropriation from the California Arts Council Contribution and Donations Fund to the Arts Council.

Vote: majority. Appropriation: yes. Fiscal committee: yes. State-mandated local program: no.

The people of the State of California do enact as follows:

SECTION 1.  

Section 8753.6 is added to the Government Code,

8753.6.  

(a) The California Arts Council Contribution and
4Donations Fund is hereby created in the State Treasury to receive
5funds pursuant to subdivision (m) of Section 8753. Notwithstanding
6Government Code Section 13340, the moneys in the fund are
7continuously appropriated, without regard to fiscal years, to the
8Arts Council for the purposes of this chapter.

9(b) Any moneys in the Art Council Donations Account in the
10Special Deposit Fund shall be transferred to the California Arts
11Council Contribution and Donations Fund.
