Existing law provides that school districts offering kindergarten may maintain kindergarten classes at different schoolsites for different lengths of time.

The bill would require a local educational agency, commencing with the 2015-16 school year, to provide an annual report to the State Department of Education that contains information on the type of kindergarten program offered by the local educational agency, as provided, in a manner determined by the department. By expanding the duties of a local educational agency, the bill would create a state-mandated local program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to these statutory provisions.

14(1) The instructional, social, emotional, and developmental
15needs of children.

16(2) Teacher and other school staffing issues.

2(b) The Superintendent may convene a task force to advise the
3Superintendent on feasibility and implementation issues for the
4purposes of preparing the report required pursuant to subdivision
5(a). The task force shall include representatives of school district
6superintendents, principals, kindergarten teachers, related pupil
7support services and facility personnel, child development
8 professionals, and parents.

9(b) The evaluation shall include a sample of local educational
10agencies’ full day and part-day kindergarten programs from across
11the state. It is the intent of the Legislature that this sample be
12representative of the diversity of the state, and shall include both
13urban and rural and small and large local educational agencies
14within school districts.

15(c) The report required pursuant to this section shall be submitted
16in compliance with Section 9795 of the Government Code.

17(d) This section shall not become operative until the Legislature
18makes an appropriation for these purposes in the annual Budget
19Act or in any other statute.
