An act to amend Section 19209 of the Public Contract Code, relating to courts.

Existing law requires the Judicial Council to provide two annual reports each year to the Joint Legislative Budget Committee and the State Auditor that provides information related to the procurement of contracts for the judicial branch.

This bill would require the two annual reports to include a list of all contracts, contract history of amendments, and other specified information about how and to whom the contract was let. This bill would also require the reports to be provided in an electronic format, as specified.

SECTION 1.  

Section 19209 of the Public Contract Code is

19209.  

(a) Notwithstanding Section 10231.5 of the
4Government Code, beginning in 2012, twice each year, the Judicial
5Council shall provide a report to the Joint Legislative Budget
6Committee and the State Auditor that provides information related
P2    1to procurement of contracts for the judicial branch. One report
2shall be provided no later than February 1 of each year, covering
3the period from July 1 through December 31 of the prior year, and
4the second report shall be provided no later than August 1 of each
5year, covering the period from January 1 through June 30 of the
6same year.

7(b) Each of the two annual reports shall include a list of all
8vendors or contractors receiving payments from any judicial branch
9entities. For each vendor or contractor receiving any payment
10during the reporting period, the report shall provide a separate
11listing for each distinct contract between that vendor or contractor
12and a judicial branch entity. For every vendor or contractor listed
13in the report, including for each distinct contract for those
14contractors or vendors with more than one payment during the
15period, the report shall further identify the amount of payment to
16the contractor or vendor, the type of service or good provided, and
17the judicial branch entity or entities with which the vendor or
18contractor was contracted to provide that service or good.

19(c) Each of the two annual reports shall include a list of all

22the report period. For each amendment, the report shall identify
23the vendor or contractor, the type of service or good provided
24under the contract, the nature of the amendment, the duration of
25the amendment, and the cost of the amendment.

26(d) Each of the two annual reports shall include a list of all
27contracts entered into during the report period, including the dates,
28amounts, and durations of the contracts.

29(e) Each of the two annual reports shall include information on
30whether each contract was competitively bid, the justification for
31contracts that were not competitively bid, and identify whether the
32contract was with a disabled veteran business enterprise.

33(f) Each of the two annual reports shall identify, for an
34information technology contract, whether the contract was with
35a small business, as defined in subdivision (d) of Section 14837
36of the Government Code.

37(g) Each of the two annual reports shall be provided in an
38electronic format in which the date can be readily searched, sorted,
39extracted, organized, or filtered.
