An act to amend Section 316 of the Streets and Highways Code, relating to state highways.

Existing law gives the Department of Transportation full possession and control of all state highways. Existing law describes the authorized routes in the state highway system and establishes a process for adoption of a highway on an authorized route by the California Transportation Commission. Existing law authorizes the commission to relinquish certain state highway segments to local agencies.

This bill would authorize the commission to relinquish to the City of Sacramento the portion of State Highway Route 16 that is located within the city limits of that citybegin insert,end insert and to relinquish to the County of Sacramentobegin delete theend deletebegin insert a specifiedend insert portion of State Highway Route 16 that is located within the unincorporated area of that countybegin insert,end insert under certain conditions.

The people of the State of California do enact as follows:

SECTION 1.  

Section 316 of the Streets and Highways Code
2 is amended to read:

316.  

(a) Route 16 is from:

2(1) Route 20 to Route 5 near Woodland via Rumsey and
3Woodland.

4(2) Watt Avenue to Route 49 near Drytown.

5(b) Upon a determination by the commission that it is in the
6best interests of the state to do so, the commission may, upon terms
7and conditions approved by it, relinquish to the City of Sacramento
8the portion of Route 16 that is located within the city limits of that
9city if the city agrees to accept it. The following conditions shall
10apply upon relinquishment:

11(1) The relinquishment shall become effective on the date
12following the county recorder’s recordation of the relinquishment
13 resolution containing the commission’s approval of the terms and
14conditions of the relinquishment.

15(2) On and after the effective date of the relinquishment, the
16relinquished portion of Route 16 shall cease to be a state highway.

17(3) The portion of Route 16 relinquished under this subdivision
18shall be ineligible for future adoption under Section 81.

19(4) For the portion of Route 16 relinquished under this
20subdivision, the City of Sacramento shall apply for approval of a
21business route designation for the relinquished portion of the
22highway in accordance with Chapter 20, Topic 21, of the Highway
23Design Manual.

24(5) For the portion of Route 16 relinquished under this
25subdivision, the City of Sacramento shall install and maintain
26within its jurisdiction signs directing motorists to the continuation
27of Route 16 to the east.

28(6) The City of Sacramento shall maintain the Surface
29Transportation Assistance Act (STAA) truck route designation for
30the portion of Route 16 relinquished that previously held that
31designation.

32(c) Upon a determination by the commission that it is in the best
33interests of the state to do so, the commission may, upon terms
34and conditions approved by it, relinquish to the County of
35Sacramento the portion of Route 16 that is located within the
36unincorporated area of that county,begin insert end insertbegin inserteast of the City of Sacramento
37boundary and west of Watt Avenue,end insert
if the county agrees to accept
38it. The following conditions shall apply upon relinquishment:

39(1) The relinquishment shall become effective on the date

9of a business route designation for the relinquished portion of the
10highway in accordance with Chapter 20, Topic 21, of the Highway
11Design Manual.

12(5) For the portion of Route 16 relinquished under this
13subdivision, the County of Sacramento shall install and maintain
14within its jurisdiction signs directing motorists to the continuation
15of Route 16 to the east.

16(6) The County of Sacramento shall maintain the STAA truck
17route designation for the portion of Route 16 relinquished that
18previously held that designation.
