An act to amend Section 316 of the Streets and Highways Code, relating to state highways.

AB 1957, as amended, Dickinson. State Highway Route 16.

Existing law gives the Department of Transportation full possession and control of all state highways. Existing law describes the authorized routes in the state highway system and establishes a process for adoption of a highway on an authorized route by the California Transportation Commission. Existing law authorizes the commission to relinquish certain state highway segments to local agencies.

This bill would authorize the commission to relinquish to the City of Sacramento the portion of State Highway Route 16 that is located within the city limits of that city, and to relinquish to the County of Sacramento a specified portion of State Highway Route 16 that is located within the unincorporated area of that county, under certain conditions.

Vote: majority. Appropriation: no. Fiscal committee: yes. State-mandated local program: no.

The people of the State of California do enact as follows:

SECTION 1.  

Section 316 of the Streets and Highways Code

316.  

(a) Route 16 is from:

4(1) Route 20 to Route 5 near Woodland via Rumsey and
5Woodland.

8(b) Upon a determination by the commission that it is in the
9best interests of the state to do so, the commission may, upon terms
10and conditions approved by it, relinquish to the City of Sacramento
11the portion of Route 16 that is located within the city limits of that
12city if the city agrees to accept it. The following conditions shall
13apply upon relinquishment:

14(1) The relinquishment shall become effective on the date
15following the county recorder’s recordation of the relinquishment
16 resolution containing the commission’s approval of the terms and
17conditions of the relinquishment.

18(2) On and after the effective date of the relinquishment, the
19relinquished portion of Route 16 shall cease to be a state highway.

20(3) The portion of Route 16 relinquished under this subdivision
21shall be ineligible for future adoption under Section 81.

22(4) For the portion of Route 16 relinquished under this
23subdivision, the City of Sacramento shall apply for approval of a
24business route designation for the relinquished portion of the
25highway in accordance with Chapter 20, Topic 21, of the Highway
26Design Manual.

27(5) For the portion of Route 16 relinquished under this
28subdivision, the City of Sacramento shall install and maintain
29within its jurisdiction signs directing motorists to the continuation
30of Route 16 to the east.

31(6) The City of Sacramento shall maintain the Surface
32Transportation Assistance Act (STAA) truck route designation for
33the portion of Route 16 relinquished that previously held that
34designation.

35(c) Upon a determination by the commission that it is in the best
36interests of the state to do so, the commission may, upon terms
37and conditions approved by it, relinquish to the County of
38Sacramento the portion of Route 16 that is located within the
P3    1unincorporated area of that county, east of the City of Sacramento
2boundary and west of Watt Avenue, if the county agrees to accept
3it. The following conditions shall apply upon relinquishment:

4(1) The relinquishment shall become effective on the date
5following the county recorder’s recordation of the relinquishment
6resolution containing the commission’s approval of the terms and
7conditions of the relinquishment.

8(2) On and after the effective date of the relinquishment, the
9relinquished portion of Route 16 shall cease to be a state highway.

10(3) The portion of Route 16 relinquished under this subdivision
11shall be ineligible for future adoption under Section 81.

12(4) For the portion of Route 16 relinquished under this
13subdivision, the County of Sacramento shall apply for approval
14of a business route designation for the relinquished portion of the
15highway in accordance with Chapter 20, Topic 21, of the Highway
16Design Manual.

17(5) For the portion of Route 16 relinquished under this
18subdivision, the County of Sacramento shall install and maintain
19within its jurisdiction signs directing motorists to the continuation
20of Route 16 to the east.

21(6) The County of Sacramento shall maintain the STAA truck
22route designation for the portion of Route 16 relinquished that
23previously held that designation.
