Existing law prescribes required courses of study in grades 1 to 12, inclusive, and requires the adopted course of study to include instruction, as provided, at the appropriate elementary and secondary grade levels.

The bill would authorize school districts, county offices of education, and charter schools to provide age-appropriate instruction, pursuant to the content standards adopted by the state board, forbegin delete transitional kindergarten, kindergarten,end deletebegin insert kindergartenend insert and grades 1 to 12, inclusive,begin delete as applicable,end delete
in sexual abuse and sexual assault awareness and prevention. The bill would provide a procedure for excusing a pupil from that instruction.

(a) (1) The state board shall, based upon
4recommendations by the Superintendent, consider including
5age-appropriate content for kindergarten and grades 1 to 12,
6inclusive, in sexual abuse and sexual assault awareness and
7prevention, including information on available counseling and
8resources for children who are sexually abused, in the next revision
9of the health content standards.
10(2) The state board shall, based upon recommendations by the
11Instructional Quality Commission, consider including information
12in sexual abuse and sexual assault awareness and prevention,
13including information on available counseling and resources for
14children who are sexually abused, in the Health Framework for
15California Public Schools when
next revised.
16(b) (1) School districts, county offices of education, and charter
17schools may provide age-appropriate instruction, pursuant to the
P3 1content standards adopted by the state board under subdivision
2(a), for kindergarten and grades 1 to 12, inclusive, as applicable,
3in sexual abuse and sexual assault awareness and prevention.
4(2) Upon written request of the pupil’s parent or legal guardian,
5a pupil in kindergarten or grades 1 to 12, inclusive, shall be
6excused from taking instruction in sexual abuse and sexual assault
7awareness and prevention established pursuant to this section.
Section 51207 is added to the Education Code,
9to read:
(a) (1) On or before March 1, 2017, the state board
11shall, based upon the recommendations of the Superintendent,
12consider adopting age-appropriate content standards for transitional
13kindergarten, kindergarten, and grades 1 to 12, inclusive, in sexual
14abuse and sexual assault awareness and prevention, including
15information on
available counseling and resources for children
16who are sexually abused.
17(2) The state board shall, based upon a recommendation by the
18Superintendent, consider including information in sexual abuse
19and sexual assault awareness and prevention, including information
20on available counseling and resources for children who are sexually
21abused, in the Health Framework for California Public Schools
22when next revised.
23(b) (1) School districts, county offices of education, and charter
24schools may provide age-appropriate instruction, pursuant to the

26(a), for transitional
kindergarten, kindergarten, and grades 1 to 12,
