BILL ANALYSIS Ó AB 2063 Page 1 Date of Hearing: April 23, 2014 ASSEMBLY COMMITTEE ON LABOR AND EMPLOYMENT Roger Hernández, Chair AB 2063 (Chavez) - As Amended: March 28, 2014 SUBJECT : Employment: car washes: online registration. SUMMARY : Authorizes employers in the car washing and polishing industry to submit their required application for registration, fees and supporting documentation online. Specifically, this bill : 1)Requires the Labor Commissioner to develop and provide a registration form for car wash employers that may be completed online and provide for the payment of fees electronically on the website of the Department of Industrial Relations. 2)Provides the required copies of workers' compensation insurance policies, registration fees, and copies of required surety bonds may be filed electronically. 3)Provides that proof of registration shall be available in a form that may be printed from the website of the Department of Industrial Relations. 4)Makes other related and conforming changes. EXISTING LAW regulates the employment practices of employers in the car washing and polishing industry and, among other things, requires such employers to register with the Labor Commissioner and pay a specified registration fee and annual fee, or be subject to a specified civil fine. FISCAL EFFECT : Unknown COMMENTS : This bill seeks to modernize the registration process for the car washing and polishing industry by allowing employers to submit their required application for registration, fees and supporting documentation online. The bill requires the Labor Commissioner to develop and provide a registration form for car wash employers that may be completed online and provide for the payment of fees electronically on the website of the Department of Industrial Relations (DIR). AB 2063 Page 2 According to the author, in an effort to become more efficient, DIR should update its codes to use modern technology and accept the submission of registrations online. By accepting online registrations, DIR will reduce the processing of paperwork required by both the applicant and DIR and add a level of convenience for those car wash owners who are trying to stay in compliance with existing law. Online registration has been expanded to Drivers' License Renewals, Voter Registration, and Unemployment Insurance Benefit Claim Forms, and should be expanded to help this industry become more efficient. The author concludes that this is an easy way to help make government more efficient while helping small businesses in California Similarly, the Western Carwash Association (WCA) states that this bill will provide carwashes with an updated means by which to provide the Labor Commissioner with the information required for annual registration requirements. WCA states that its membership predominately consists of small and medium sized businesses and by allowing its members to register online, this bill will enable them to reduce costs, ensure receipt and increase compliance.
