   An act to  amend Section 38560 of   add
Section 38575 to  the Health and Safety Code, relating to
greenhouse gases.

   AB 2083, as amended, Beth Gaines. California Global Warming
Solutions Act of 2006:  rules and regulations.

   The California Global Warming Solutions Act of 2006 designates the
State Air Resources Board as the state agency charged with
monitoring and regulating sources of emissions of greenhouse gases.
The state board is required to adopt a statewide greenhouse gas
emissions limit equivalent to the statewide greenhouse gas emissions
level in 1990 to be achieved by 2020, and to adopt rules and
regulations in an open public process to achieve the maximum,
technologically feasible, and cost-effective greenhouse gas emissions
reductions.  The act authorizes the state board to include the
use of market-based compliance mechanisms.  
   This bill, if the state board uses its authority to include the
use of market-based compliance mechanisms, would require the state
board to allow a regulated entity to use offsets to meet its
compliance obligation regardless of the geographic location of the
offset.  
   This bill would make a technical, nonsubstantive change to this
provision.

THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

   SECTION 1.    Section 38575 is added to the 
 Health and Safety Code   , to read:  
   38575.  (a) If the state board has exercised its authority
pursuant to subdivision (a) of Section 38570, the state board shall
allow a regulated entity to use offsets to meet its compliance
obligation regardless of the geographic location of the offset.
   (b) For purposes of subdivision (a), a verified offset shall be
real, permanent, quantifiable, verifiable, and enforceable, pursuant
to subdivision (d) of Section 38562.  
  SECTION 1.    Section 38560 of the Health and
Safety Code is amended to read:
   38560.  The state board shall adopt rules and regulations in an
open public process to achieve the maximum technologically feasible
and cost-effective greenhouse gas emissions reductions from sources
or categories of sources, subject to the criteria and schedules set
forth in this part.
