An act to amend Section 6502 of the Government Code, relating to joint powers.

LEGISLATIVE COUNSEL’S DIGEST

AB 2170, as amended, Mullin. Joint powers authorities: common powers.

Existing law provides that 2 or more public agencies, by agreement, may form a joint powers authority to exercise any power common to the contracting parties, as specified.

This bill would provide that the parties to the agreement may exercise any power common to the contracting parties, including, but not limited to, the authority to levy a feebegin insert, assessment,end insert or tax, as specified.

Vote: majority. Appropriation: no. Fiscal committee: no. State-mandated local program: no.

The people of the State of California do enact as follows:

SECTION 1.  

The Legislature finds and declares that, pursuant
2to Section 6502, a joint powers authority has all powers common
3to the contracting parties, so long as those powers are specified in
4the joint powers agreement;begin delete therefor,end deletebegin insert therefore,end insert the amendments
5to that section by this bill do not constitute a change in, but are
6declaratory of, existing law.

SEC. 2.  

Section 6502 of the Government Code is amended to

6502.  

If authorized by their legislative or other governing
4bodies, two or more public agencies by agreement may jointly
5exercise any power common to the contracting parties, including,
6but not limited to, the authority to levy a feebegin insert, assessment,end insert or tax,
7even though one or more of the contracting agencies may be located
8outside this state.

9It shall not be necessary that any power common to the
10contracting parties be exercisable by each such contracting party
11with respect to the geographical area in which such power is to be
12jointly exercised. For purposes of this section, two or more public
13agencies having the power to conduct agricultural, livestock,
14industrial, cultural, or other fairs or exhibitions shall be deemed
15to have common power with respect to any such fair or exhibition
16conducted by any one or more of such public agencies or by an
17entity created pursuant to a joint powers agreement entered into
18by such public agencies.
